RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VI5TA, CALIFORNIA, RECITING THE FACT OF
THE GENERAL MUI`IICIPAL ELECTION HELD IN SAID CITY
OF CHULA VISTA ON THE 11th DAY OF APRIL, 1978,
DECLARING THE RESULT THEREOF AND SUCH OTHER
MATTERS AS ARE PROVIDED BY THE PP.OVISIONS OF THE
CHARTER OF THE CITY OF CHULA VI5TA
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, a regular general municipal election was held
and conducted in the City of Chula Vista, County of San Diego,
State of California, on Tuesday, the 11th day of April, 1978, as
required by the Charter of the City of Chula Vista, and
WHEREAS, notice of said election was duly and regularly
given in time, form and manner as provided. by law; that voting
precincts were properly established; that election officers were
appointed and that in all respects said election was held and con-
ducted and the votes cast thereat, received and canvassed and the
returns made and declared in tine, form and manner as required by
the provisions of the Elections Code of the State of California
for the holding of elections in cities, and
WHEREAS; pursuant to Resolution No. 9050, adopted the
28th day of March, 1978, the City Clerk of the City of Chula Vista
canvassed the returns of said election and has certified the results
to this City Council, said results are received, attached and made
a part hereof as "Exhibit A."
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CHULA
VISTA, CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. That there were 94 voting precincts esta-
blished for the purpose of holding said election consisting of
the regular elections precincts in the City of Chula Vista as
established for the holding of state and county elections.
Section 2. That said regular general municipal election
was held for the purpose of electing the following officers of
said City as required by the City of the City of Chula Vista, to
wit:
Two (2) members of the City Council of said City for
the full term of four years, Seat No. 3 and Seat No. 4;
Two (2) members on the Board of Education, Chula Vista
Elementary School District.
Section 3. That at said regular general municipal elec-
tion, the following measures were submitted to the electors of
said City, to wit:
PROPOSITION A
Amend Article III, Section 304 thereof, of the Charter of the
City of Chula Vista to be, and to read as follows:

Sec. 304. Presiding Officer, Mayor.
(a) Mayor, There shall be elected at the general
municipal election a Mayor who shall hold office for
a term of four years and until a successor is elected
and qualified.
(b) Duties. The Mayor shall be a member of the
City Council and shall perform all the functions and
have all of the powers and rights of a duly elected
Councilmember. In addition to said powers and duties,
the mayor shall have the power and duty: (1) to report
to the City Council annually and from time to time on
the affairs of the City and to recommend for its con-
sideration such matters as deemed expedient, and (2)
to be the official head of the City for all political
and ceremonial purposes and shall be recognized by the
courts for the purpose of serving civil process, for
the signing of all legal instruments and documents,
and by the Governor for emergency purposes, and (3)
in the time of public danger or emergency, the mayor,
with the consent of the Council and for period as the
Council may fix, take command of the police, maintain
order and enforce the law, and (4) to assume the pri-
mary but not the exclusive responsibility for inter-
preting to the people the policies, programs and needs
of the City government and for informing the people of
any major change in policy or program. The r'iayor may
represent the City in any and all matters involving
other governmental agencies, provided that no act,
promise, commitment or agreement entered into or com-
mitted by the Mayor shall be binding upon the City of
Chula Vista unless duly authorized or ratified by the
City Council, and (5) to represent the City in all
regional public agencies which require an elected City
official, unless otherwise determined by the City
Council, and (6) Supervise the operation of the Mayor/
Council office and personnel assigned thereto, and (7)
to perform such other duties consistent with the office
as may be prescribed by this Charter or delegated to
the D4ayor or imposed on the P~Zayor by the City Council
if not inconsistent with the provisions of this Charter
and (8) to exercise the function as Mayor of the City
during the usual business hours that the offices of the
City are open, and such other hours and times as shall
be necessary to discharge in full the duties imposed
upon the Mayor.
(c) Compensation. The Mayor shall receive as a
salary the amount a Councilmember receives as authorized
under State law pursuant to Section 302 herein, multi-
plied by a factor of four (4). The Mayor shall also
be reimbursed for Council authorized travel and related
expenses and a sum as set by resolution of the City
Council.
(d) Mayor Pro Tempore. The City Council shall also
designate one of its members as mayor Pro Tempore, who
shall serve in such capacity at the pleasure of the
City Council. The 1`Rayor Pro Tempore shall perform the
duties of the Mayor during the Mayor's absence or dis-
ability.

PROPOSITION B
Amend Article XII, Section 1202 thereof, of the Charter o~f the
City of Chula Vista to be, and to read as follows:
Sec. 1202. Eligibility.
No person shall be eligible to hold office as a
member of the Board of Education unless a qualified
elector of the territory comprising the School
District.
PROPOSITION C
A certain measure for adoption as an ordinance by the Council of
the City of Chula Vista to be, and to read as follows:
Shall the ordinance approving the development, con-
struction and acquisition of low-rent housing projects
not to exceed 400 units on scattered sites within
the City of Chula Vista for persons of low-income,
including senior citizens and the handicapped, be
adopted?
Section 4. That the whole number of votes cast in said
City (except absent voter ballots) was 11,358.
That the whole number of absent voter ballots cast in
said City was 201, making a total of 11,559 votes cast in said
City.
Section 5. That the names of persons voted for at said
election for members of the City Council of said City were as
follows:

Leon Lauterbach
Frederick A. R. Drew
That the names of the persons voted for at said election
for Board of Education, Chula Vista Elementary School District were
as follows:
Sharon Masumoto
Norman G. Williams
Sandee Redman
Opal Fuller
Armando Y. Casillas
That the propositions voted upon at said election are
as set forth herein above, and
That the number of votes given at each precinct and the
number of votes given in the City to each of such persons above
named for the respective offices for which said persons were can-
didates (and for and against the measure) were as listed in
"Exhibit "A" attached.

that:
Section 6. The City Council does declare and determine
Frank A. Scott was elected as member of the City Council
of said City for the full term of four years for Seat
No. 3;
That there will be a runoff between George B. Gillow
and Leonard rY. PZoore for member of the City Council,
Seat No. 4 on the June 6, 1978 Statewide Primary
Election ballot;
Sharon r4asumoto and Opal Fuller were elected as members
of the Board of Education, Chula Vista Elementary School
District for the full term of four years;
That as a result of said election, a majority of the
qualified voters voting on Propositions A and B, did not
vote in favor thereof; and that said changes were not
carried and shall not be deemed adopted and ratified,
and
That as a result of said election, a majority of the
voters voting on Proposition C did vote in favor thereof
and that said proposition carried, and shall be deemed
adopted and ratified.
Section 7. The City Clerk shall enter on the records of
the City Council of said City, a statement of the result of said
election, showing:
(1) The whole number of votes cast in the City;
(2) The names of the persons voted for;
(3) The measures voted upon;
(4) For what office each person was voted for;
(5) The number of votes given at each precinct to
each person, and for and against each measure;
(6) The number of votes given in the City to each
person, and for and against each measure.
Section 8. That the City Clerk shall immediately make
and deliver to each of such persons so elected a Certificate of
Election signed by the City Clerk and duly authenticated; that the
City Clerk shall also administer to each person elected, the Oath
of Office prescribed in the State Constitution of the estate of
California and shall have them subscribe thereto and file the
same in the office of the City Clerk. Whereupon, each and all of
said persons so elected shall be inducted into the respective
office to which they have been elected.
Section 9. That the City Clerk shall certify to the pas-
sage and adoption of this resolution; shall enter the same in the
book of original Resolutions of said City; and. shall make a minute
of the passage and adoption thereof in the records of the proceed-
ings of the City Council of said City, in the minutes of the
meeting at which the same is passed and adopted.

I, Jennie M. Fulasz, City Clerk of the City of Chula Vista, California, County
of San Diego, State of California, duly authorized by Resolution No. 9050,
adopted by the City Council of said City on the 28th day of March 1978, do
hereby certify that I have canvassed the returns of the regular general municipal
election held in said city on the 11th day of April 1978 and find that the number
of votes given at each precinct and the number of votes given in the City to
persons voted for, the respective office for which said persons were candidates and
for and against the measures were as follows:
That the whole number of votes cast in the City of Chula Vista, California, and
within the Chula Vista Elementary School District was 11,424.
That the following person was elected to fill the office of Councilman - Seat No. 3
for a term of four years:
Frank A. Scott
That there will be a run off for Councilman - Seat No. 4 in the June 6, 1978 State
wide Primary Election between
George B. Gillow
Leonard A-I. Moore
due to the fact that no candidate received a majority of the votes cast for this
Seat and Mr. Gillow and Mr. Moore received the highest number of votes cast.
That the following persons were elected to fill the office of the Board of Education
(Chula Vista Elementary School District) for a term of four years:

Opal Fuller
That the following propositions were voted upon at said election:
PROPOSITION A: An amendment to theCharter of the City of Chula Vista
amending Article III, Section 304 thereof, redefining the duties of
the Mayor requiring him to discharge said duties on a full-time basis
and establishing, a salary for the Mayor in an amount equal to four times
that received by the members of the Council, which Council salary will be
the sum of $407 per month as of May 1, 1978.

PROPOSITION B: An amendment to the Charter of the City of Chula Vista
amending Article XTI, Section 1202 thereof, deleting the requirement
for one year residency prior to the election or appointment for members
of the Board of Education of the Chula Vista School District.
PROPOSITION C: Shall the ordinance approving the development, con-
struction and acquisition of low-rent housing projects not to exceed
400 units on scattered sites within the City of Chula Vista for persons
of low.-income, including senior citizens and the handicapped, be adopted?
That as a result of said election, a majority of the qualified voters
voting on said Propositions A and B relating to the Charter changes did
vote against the propositions and therefore they shall be deemed defeated.
That as a result of said election, a majority of the qualified voters
voting on said Proposition C did vote in favor thereof, and that said
Proposition carried and shall be deemed adopted.
That attached hereto and made a part hereof is a list of persons voted for
and the propositions and measure voted on, together with the number of votes
received in each precinct (94 precincts) and the total votes received in
the election,
I certify that the foregoing statement of results is a full, true and
correct statement of the facts of said canvass and of the results of said
election, and that as soon as the result was declared, the aforesaid stat e
ment was duly entered by me, the City Clerk of tfie City of Chula Vista,
on the records of said City Council,
