RESOLUTION NO. 13931
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA APPROPRIATING ~500,000 FROM THE
UNAPPROPRIATED RESERVE OF THE GENERAL FUND FOR
THE CONSTRUCTION OF THE TELEGRAPH CANYON CREEK
FLOOD CONTROL CHANNEL PROJECT - ADDITIONAL
FUNDING
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the City entered into the Local Cooperation
Agreement between the Department of the Army and the City of
Chula Vista for the Telegraph Canyon Creek Flood Control Project
as approved by City Council Resolution No. 13186 on August 4,
1987, and
WHEREAS, Article VI Section b.4 of said agreement
provides that "if at any time during the period of construction
the Government determines that additional funds will be needed
from the City to meet its required share of project costs, the
Government shall so notify the City, and the City within (60)
days from receipt of notice, shall make the necessary funds
available through the funding mechanism specified above", and
WHEREAS, the Telegraph Canyon Creek Flood Control
channel project has been under construction for one year and is
now about 85% complete, and
WHEREAS, in 1987, prior to award of the contract, the
City's share of this project was estimated to be ~4,687,850 with
the federal share of the project being set by law at ,5,000,000,
and
WHEREAS, the City's share includes the costs to acquire
rights-of-way, to relocate utilities and construction costs
exceeding the federal participation limitation, thus, the total
cost of the project was estimated at ,9,687,850, and
WHEREAS, in previous years, Council budgeted the
$4,687,850 which was expected to be the total City's share of the
project and the Corps of Engineers has now notified us that the
construction budget has been exceeded due to quantity overruns
and change orders, and
WHEREAS, the federal funds have been spent and the Corps
has notified us of their intent to bill us in early January, 1989
for additional funds, and

WHEREAS, it is estimated that an additional ~500,000 is
needed at this time in order to meet the City's obligation, and
WHEREAS, it is anticipated that at least ~500,000 in
excess of that amount expected will be reimbursed to the City
from the State of California Department of Water Resources.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Chula Vista does hereby appropriate ~500,000 from the
unappropriated reserve of the General Fund to Account No.
600-6000-GF33 for the additional funding required for the
construction of the Telegraph Canyon Creek Flood Control Channel
Project.
BE IT FURTHER RESOLVED that the Director of Finance is
directed to deposit the reimbursement from the Department of
Water Resources in excess of ~693,000 into the General Fund.
