RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA DECLARING ITS INTENTION TO CONDUCT A PUBLIC
HEARING TO CONSIDER THE DEFERRAL OF UTILITY UNDER-
GROUNDING REQUIREMENTS AT 1150 WALNUT AVENUE
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, Section 15.32.040 of the Chula Vista Municipal
Code provides that the City Council may vary from or defer the
requirements of undergrounding utilities in a subdivision if the
City Council finds from the evidence presented at the public
hearing that all of the following facts exist:
1. That extraordinary conditions exist to the extent
that enforcement of this subsection would result
in unnecessary hardship to the subdivider or the
utility company.
2. That such deferral will not, under the circumstances
of the particular case, be detrimental to the health,
safety or gen e ral welfare of the neighborhood.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Chula Vista does hereby declare its intention to conduct
a public hearing for the purpose of whether to defer the underground-
ing of utilities at 1150 Walnut Avenue on Tuesday, April 18, 1978 at
7:00 p.m. in the Council Chambers, City Hall, 276 Fourth Avenue,
Chula Vista, California.
BE IT FURTHER RESOLVED that the City Clerk of the City of
Chula Vista be, and she is hereby directed to cause a copy of this
resolution to be published once in a newspaper of general circulation
published within the City of Chula Vista, and to cause notices of
the passage of this resolution to be posted in the manner and form
required by law.
