HomeMy WebLinkAboutAgenda Statement 1978/03/14 Item 20CITY OF CHULA VISTA COUNCIL AGENDA STATEMENT Item No. 20 i For meeting of 3/14/78 ITC~M TITLE Resolution'~90-3~ - Approving Agreement with Carter/Hawley Hale Stores, Inc., Establishing Certain Restrictions in the Develop- ment of the Chula Vista Square Shopping Center ~- SUBMITTED BY City Attorney ITEM EXPLANATION (4/5TH'S VOTE REQUIRED YES NO X ) The Carter/Hawley Hale Stores have had a proposed Burger King site plan approved for a location at the northeast corner of Broadway and I Street. However, because of lot lines that exist on properties all under the ownership of Carter/Hawley Hale, the Department of Building and Housing has indicated that certain requirements must be met to satisfy the Uniform Building Code. First of all, it should be recognized that there is some body of law that holds that because of the common ownership, that the lots have in effect been merged especially in light of their use for a common purpose, i.e., the development of the Chula Vista Square Shopping Center. However, irrespective of this, it does not seem necessary to strictly adhere to Building Code requirements if the reasons for such requirements relating to fire walls can be eliminated by an appropriate agreement. The agreement would prevent construction of any building or structure within fifty feet of the Burger King property line. Such an agreement has been prepared by the City Attorney's office and executed by Carter/ Hawley Hale Stores and is ready for approval of the City Council.
