HomeMy WebLinkAboutReso 1978-9141RESOLUTION NO . 91 ~ 1 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ORDERING THE BRADLEY REORGANIZATION INVOLVING AN ANNEXATION TO THE CITY OF CHULA VISTA AND A DETACHMENT FROM THE SAN DIEGO COUNTY FLOOD CONTROL DISTRICT, THE BONITA SUNNYSIDE FIRE PROTECTION DISTRICT AND THE LOWER SWEETWATER FIRE PROTECTION DISTRICT The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, pursuant to the District Reorganization Act of 1965, commencing with Section 5600 of the Government Code, a petition has been received by the City Clerk of the City of Chula Vista pro- posing a reorganization consisting of the following changes of organization: 1. Annexation of territory described in Exhibit B to the City of Chula Vista, and 2. Detachment of the territory described in Exhibit B from the San Diego County Flood Control District - Zone 3. 3. Detachment or withdrawal of the territory described in Exhibit B from the Bonita-Sunnyside Fire Pro- tection District. 4. Detachment or withdrawal of the territory described in Exhibit B from the Lower Sweetwater Fire Pro- tection district, and WHEREAS, the petition of landowners constituting 100 consent to said reorganization and no public hearing has been con- ducted in accordance with the provisions of Section 56430 et seq. of the Government Code, and WHEREAS, at its regular meeting of September 13, 1977, the City Council approved the boundaries of the Bradley Reorgani- zation and authorized staff to file the proposed reorganization with LAFCO, which by resolution dated May 1, 1978 approved said Bradley Reorganization subject to the requirement that the des- cription of the boundaries be modified to conform to Exhibit B, attached hereto, and WHEREAS, the Planning Commission, at its meeting of May 24, 1978, adopted Resolution No. PCZ-78-C recommending to the City Council the prezoning of the .82 acre Bradley parcel from A-8-F to C-V-P-F. NOW, THEREFOP.E, BE IT RESOLVED that the City Council hereby finds and determines and orders as provided in Government Code Section 56430 et seq. as follows: 1. The territory proposed for reorganization (herein- after referred to as the Territory) is as described in Exhibit B attached hereto. 2. The description of the boundaries of the Territory is not definite and certain, but may be made so if modified to conform to Exhibit B attached hereto. -1- 3. The description of the boundaries of the Territory conforms to lines of assessment and ownership. 4. All owners of land have consented in writing to the proposed reorganization. 5. The Territory includes 21.95 acres and is uninhabited. 6. The Commission has certified that it has reviewed and considered the information contained in the Negative Declaration prepared by the City of Chula Vista. 7. The Commission has approved a proposed reorganization consisting of annexation of territory described in Exhibit B and attached hereto to the City of Chula Vista, and detachment of territory described in Exhibit B and attached hereto from the San Diego County Flood Control District - Zone 3. 8. The City of Chula Vista further has withdrawn said territory from the Bonita-Sunnyside Fire Protection District and from the Lower Sweetwater Fire Protec- tion District. 9. Pursuant to Government Code Section 56271.1, the City of Chula Vista has initiated the reorganization pro- ceedings in compliance with Government Code Section 56340 et seq. and the resolution of LAFCO, and does hereby order said reorganization without notice and hearing and without an election. 10. The City Clerk of the City of Chula Vista be, and she is hereby authorized and directed to transmit a cer- tified copy of this resolution in accordance with Section 56450 et seq. of the Government Code.
