A. BACKGROUND
1. The applicant has submitted a precise plan for the development of a commercial
structure with related parking and landscaping on a 0.32 acre parcel located at the
southwest corner of Otay Valley Road and Melrose Avenue in the C-N-P zone.
2. The Environmental Impact Report (ETR-78-12) on this project was certified by the
Planning Commission on May 10, 1978, and forwarded to the City Council on May 19, 1978.
B. DISCUSSION
1. Adjacent zoning and land use:
North R-1 (Pending R-3-P-12) Vacant
South C-N-P Vacant (condominium development approved by C.U.P.)
East C-V-P Vacant
West C-N-P Vacant
2. Existing site characteristics.
The subject property is a vacant 13,755 sq. ft. (0.32 acre) parcel with approximately
90 feet of frontage along Otay Valley Road and 150 feet along Melrose Avenue. The site
is relatively level, sloping gently from north to south.
3. Precise plan.
The applicant proposes to construct a 2400 sq, ft, (40' x 60') single story commercial
structure at the southwest corner of the site. The staff has on file a skeletal plan for

the adjoining commercial development to the west showing the general location of future
buildings, parking and landscaping. The front setbacks on both streets will be land-
scaped with additional landscaped planters in front of the building. A monument sign
is proposed at the northeast corner of the site within the landscaped area. Access to
the site will be provided by two driveways, one on each street frontage. The applicant
will be required to enter into a joint access agreement with the adjacent commercial
,property to the west in order to minimize the number of curb cuts and traffic on Otay
Valley Road.
4. Architecture.
The proposed structure is a modified version of the standard architectural design
used for the 7-Eleven stores. The basic design consists of a stucco exterior with a
shake shingle mansard roof across most of the front elevation incorporating redwood
siding on~the north and east exterior elevations. The beige stucco, wood siding and
shake shingles will make the proposed structure compatible with the existing residential
development in the area as required by the precise plan guidelines.
5. Public input.
There was no public opposition to the plan at the public hearing before the Planning
Commission.

RESOLUTION PCM-78-25
RESOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING TO THE
CITY COUNCIL THE APPROVAL OF A PRECISE PLAN FOR A 7-ELEVEN FOOD
STORE AT THE SOUTHWEST CORNER OF MELROSE AVENUE AND OTAY VALLEY
ROAD IN THE C-N-P ZONE
WHEREAS, Ordinance No. 1326, adopted by the City Council on April 7, 1971,
established the C-N-P zone on approximately 5.5 acres located south of Otay
Valley Road, west of Melrose Avenue, and
WHEREAS, on June 19, 1978, a precise plan was submitted by the Southland
Corporation for the development of a commercial structure with related parking
and landscaping on a 0.32 acre parcel located .at the southwest corner of Otay
Valley Road and Melrose in the C-N-P zone, and
WHEREAS, the City Planning Commission, at a duly advertised public hearing
held at 7:00 p.m., July 12, 1978 in the Council Chamber, City Hall, 276 Fourth
Avenue, considered the precise plan as submitted, and
WHEREAS, the Environmental Impact Report, EIR-78-12, covering the project
was certified by the Planning Commission on May 10, 1978.
NOW, THEREFORE, BE IT RESOLVED that the City Planning Commission finds as
follows:
a. That such plan will not, under the circumstances of the particular case, be
detrimental to the health, safety or general welfare of persons residing or working
in the vicinity, or injurious to property or improvements in the vicinity.
The monument sign will set back 8 feet from Otay Valley Road in order to
provide adequate visibility at the intersection. The joint access agreement
will reduce the need for additional curb cuts on Otay Valley Road.
b. That such plan satisfies the principles of the application of the P Modifying
District as set forth in Section 19.56.941.
The applicant has used redwood shake shingles on the roof and wood siding
to insure compatibility with existing and proposed development in the
vicinity as stipulated in the precise plan guidelines.
c. That any exceptions granted which deviate from the underlying zoning require-
ments shall be warranted only when necessary to meet the purpose and application
of the P Precise Plan Modifying District.
No exceptions to the Code are proposed.
d. That the approval of this plan will conform to the general plan and the adopted
policies of the city.
The subject property is located within an area designated on the General Plan
for retail commercial uses. The proposed use is in keeping with this designation.

BE IT FURTHER RESOLVED that the City Planning Commission recommends that
the City Council approve the precise plan for the development of a 7-Eleven Food
Store at the southwest corner of Otay Valley Road and P~lelrose Avenue, subject
to the following conditions:
1. The monument sign shall be a maximum of 8 feet in height from ground
level and shall maintain a minimum setback of 8 feet from Otay Valley
Road and 5 feet from Melrose Avenue.
2. No fence, wall, hedge or other feature shall be placed along the west
property line of the subject property to block free access between the
subject property and the property to the west. An agreement for joint
access to the properties shall be executed by the owners.
3. Landscaping shall adhere to the following criteria:
The dominant trees in the planters fronting Otay Valley Road and Melrose
Avenue shou~d correspond to those species predetermined by existing and
proposed landscape developments. At Melrose the existing Pine trees
should remain or 6e relocated, if required. At Otay Valley Road
eucalyptus caldocalyx or polyantheros should be introduced to corres-
pond to adjacent developments.
Use of plant material near the monument sign should be abundant, however,
it should not create any visual conflict. Plant materials adjacent to
Melrose should enhance the building elevation and sufficiently relieve
visibility of the parking lot,
Plant materials adjacent to the building should be self-contained in
character so that pruning or trimming will be unnecessary. Plants
should also be limited to ground covers and shrubs which are moderate
to small in size so as not to block light into and visibility of the
building interior.
