HomeMy WebLinkAboutReso 1988-13905 RESOLUTION NO. 13905 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ACCEPTING RESPONSIBILITY AS SUCCESSOR AGENCY TO OPERATE TWO BRANCH LIBRARIES IN CHULA VISTA IMONTGOMERY) SUBSEQUENT TO DETACHMENT FROM THE COUNTY LIBRARY DISTRICT AND APPROVING PROPERTY TAX TRANSFER The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the "Nontgomery Reorganization" was approved by the voters on November 5, 1985, and became effective in December 1985; and WHEREAS, Revenue and Taxation Code Section 991c) establishes procedures for jurisdictional changes which do not require review by the Local Agency Formation Commission, including a negotiated property tax exchange; and WHEREAS, by Resolution 112065) of the City Council on June 25, 1985, the City Council agreed on the following matter: This reorganization shall not result in a change in the Library District boundaries at this time. The City of Chula Vista shall make an annual payment to the County Library District to cover the amount the operating cost of the Castle Park and Woodlawn branch libraries that exceeds the amount of property tax estimated to accrue to the County Library District from within the territory of this "Montgomery Reorganization". That amount is currently estimated at $32,000. By mutual a9reement of the City of Chula Vista and County of San Diego, this territory may be subsequently detached from the County Library District with the City of Chula Vista as the successor agency. Such detachment would nullify this section of this resolution for subsequent years. WHEREAS, on April 5, 1988, the City last entered into a contract with the County for the provision of library service in accordance with this agreement; and WHEREAS, the City of Chula Vista and the County of San Diego, by mutual agreement, wish to terminate this agreement. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that the City and the County of San Diego hereby agree on the detachment of territory contained in the "Montgomery Reorganization" from the County Library District, with the City of Chula Vista named as the successor agency. BE IT FURTHER RESOLVED that the County of San Diego agrees to transfer all property tax revenues within the territory being detached, including base and annual tax increment, from the County Library District to the City of Chula Vista. That amount is currently estimated at $74,000. BE IT FURTHER RESOLVED that the City of Chula Vista and County of San Diego have mutually agreed to the following matters. These agreements are not intended as terms and conditions of the reorganization but are hereby ordered by both the City of Chula Vista and the County of San Diego: a, The effective date of the reorganization will be prior to December 31, 1988. b. The County agrees that it will provide contract services through June 30, 1989, as currently contracted with the City of Chula Vista. BE IT FURTHER RESOLVED that the City Clerk shall, on behalf of the adopting agencies, notify the County Auditor of this negotiated exchange of property tax revenues by forwarding a copy of this resolution. Goss, City Manager WPC 2440A -2- NO. 47 TUESDAY, DECEMBER 13, 1988 RESOLUTION OF DETACHMENT OF PROPERTY IN CMULA VISTA (MONTGOMERY) FROM COUNTY LIBRARY DISTRICT AND PROPERTY TAX EXCHANGE THEREFOR On Motion of ~upervisor Williams , seconded by Supervisor Bilbray , the following resolution is adopted: WHEREAS, the '~Montgomery Reorganization" was approved by the voters on November 5, 1985 and became effective in December 1985; and WHEREAS, Revenue ahd Taxation Code Section 99(c) establishes procedures for jurisdictional Changes which do not require review by the Local Agency Formation Commission, including a negotiated property tax exchange; and WHEREAS, by resolution of the Board of Supervisors on June 18, 1985 (#16) the Board of Supervisors agreed on the following matter: This reorganization shall not result in a change in the Library District boundaries at this time. The City of Chula vista shall make an annual payment to the County Library D~istrict to cover the amount the Qperating costs of the Castle Park and Woodlawn branch libraries that exceeds the amount of property tax estimated to accrue to the County Library District from within the territory of this "Montgomery Reorganization". WHEREAS, on January 7, 1986 the County entered into a contract with Chula Vista to provide library service in accordance with this agreement; and WHEREAS, the County and the City of Chula Vista, by mutual agreement, wish to terminate this contract and to detach the territory contained in the "Montgomery Reorganization" from the County Library District; now THEREFORE IT IS RESOLVED, ORDERED AND DETERMINED that the County of San Diego and the City of Chula Vista hereby agree on the detachment of territory contained in the "Montgomery Reorganization" fgom the County Library District, with the City of Chula Vista named as the successor agency. IT IS FURTHER RESOLVED that the County.of San Diego agrees to transfer all property tax revenues within the territory being detached, including base and annual tax increment, from the County Library DistriCt to the City of Chula Vista. No adjustment is proposed to property tax revenue for any other district, including the County of San Diego. IT IS FURTHER RESOLVED THAT the City of Chula Vista and County of San Diego have mutually agreed to the following matters. These agreements are not intended as terms and conditions of the reorganization but are hereby ordered by both the County of San Diego and the City of Chula Vista: (a) The effective date of the reorganization will be prior to December 31, 1988., (b) The County agrees that it will provide contract services through June 30, 1989, as currently contracted with the City of Chula Vista. Such contracts are at full cost recovery for the County. IT IS FURTHER RESOLVED AND ORDERED that the Clerk of the Board of Supervisors shall, on behalf of the adopting agencies, notify the County Auditor and the County Assessor and the State Board of Equalization of this detachment and this negotiated exchange of property tax revenues, by forwarding them a copy of this resolution. City Clerk CC-660 COUNCIL AGENDA STATEMENT Item 9 Meeting Date 12/20/88 ITEM TITLE: Resolution Setting Council Policy to require tapes of boards and coTnmission minutes to be kept until after minutes are officially approved At the meeting of r 22, 1988, {ouncilvloman McCandliss requested preparation of a Council Policy whereby tapes of boards, commissions or committee meetings would be kept until such time as the B/C/C/approves the minutes. RECOMMENDATION: Approve the resolution setting the Council policy of requiring B/C/C tapes to be kept until after the minutes are officially approved. DISCUSSION: At present, there does not seem to be too much of a problem in keeping the tapes of the meetings. Each B/C/C seems to have a different practice from keeping thenT only until the minutes are drafted, to keuping them "fnrever"i however, most of them keep their tapes either "forever" or for 2 years. Since there is no consistency in the keeping of these tapes, it is a good idea to set this as a policy. Resolution 7032, adopted October 2, 1973, states that policies, other than regulatory policies which are established hy ordinance, require adoption by resolution and are consolidated in the Policy t4anual. This particular Policy will also be incorporated in the B/C/C handbook. F1SCAL IMPACT: None.
