On May 2, 1978, staff submitted to the City Council a layoff rule based entirely upon
seniority. Upon direction received from the Council at that time, a different approach
was taken. The new effort has resulted in the proposal of the attached Layoff Rule.
The proposed rule has been extensively reviewed by all City department heads, by the
employee groups, by the Civil Service Commission, and the City Attorney. Agreement
has been reached on the rule as it is proposed here by all except the employee group
representing the classifications of Firefighter, Fire Engineer and Fire Captain.
A modified layoff procedure is being negotiated with that group and will be included
in their Memorandum of Understanding.
Notably, the new rule includes merit factors for use in determining order of layoff,
a point system for determining seniority, provisions for transfer and bumping, pro-
visions for reemployment, requirements-for notice to be given to employees, a section
on restoration of benefits following reemployment, and bump .charts to be used to
determine which classes may demote.
These revisions make the proposed rule more comprehensive than the rule initially
proposed on May 2, 1978. It also provides an opportunity for employee performance
to play a greater role in determining who will be laid off if layoffs become necessary..
