RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA APPROVING SUBDIVISION IMPROVEMENT AGREEMENT
BETWEEN THE CITY OF CHULA VISTA AND THE NORBIRG
CAPITAL GROWTH, INC. FOR THE COMPLETION OF PUBLIC
IMPROVEMENTS FOR TENTATIVE PARCEL MAP 4-78, AND
AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT
The City Council of the City of Chula Vista does hereby
resolve as follows:
NOW, THEREFORE, BE IT RESOLVED that that certain Subdivision
Improvement Agreement between THE CITY OF CHULA VISTA, and THE NORBIRG
CAPITAL GROWTH, INC. for the completion of public improvements for
Tentative Parcel Map 4078, dated the 20th day of July, 1978, a copy
of which is attached hereto and incorporated herein, the same as
though fully set forth herein be, and the same is hereby approved.
BE IT FURTHER RESOLVED that the Mayor of the City of Chula
Vista be, and he is hereby authorized and directed to execute said
agreement for and on behalf of the City of Chula Vista.

SUBDIVISION IMPROVEMENT AGREEMENT FOR APPROVAL OF
TENTATIVE PARCEL MAP 4-78
THIS AGREEMENT, made and entered into this nth day of
July, 1978, by and between THE CITY OF CHULA VISTA, a municipal cor-
poration, hereinafter referred to as "City", and THE NORBIRG CAPITAL
GROWTH, INC., 2555 Camino del Rio South, Suite 206, San Diego, Cali-
fornia 92198, hereinafter referred to as "Owners";
W I T N E S S E T H
WHEREAS, The Norbirg Capital Growth, Inc. has heretofore
submitted a Tentative Parcel Map 4-78 for the division of certain
property located on Quintard Street and Tobias Drive, more particularly
known as County Tax Parcel Nos. 623-070-15 and 623-070-52, and
WHEREAS, said Tentative Parcel Map meets the requirements
of the Chula Vista Municipal Code and may now be certified subject
to the fulfillment of certain conditions precedent thereto.
NOW, THEREFORE, IT IS MUTUALLY AGREED by and between the
parties hereto as follows:
1. Owners agree that prior to the approval and certifica-
tion of that certain parcel map dividing certain property located on
Quintard Street and Tobias Drive, more particularly known as County
Tax Parcel Nos. 623-070-15 and 623-070-52, that they w' either
cause those improvements as shown on Drawing Nos. 78- D and 78-205D
on file with the Public Works Department, in the est'' ed amount of

2. Owners have posted a surety bond as guarant or the
installation of improvements in the amount of $'~0_~-0

3. Owners agree that said improvements as s on Drawing
Nos. 78-204D and 78-205D shall be completed within two years from date
of Council approval of this Subdivision Improvement Agreement.
IN WITNESS WHEREOF, the parties hereto have caused this

forth.
