RESOLUTION NO. 9200
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA APPROVING THE TET7TATIVE SUBDIVISION MAP OF A
SUBDIVISION TO BE KNOWN AS TELEGRAPH CANYON TERRACE
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the Planning Commission of the City of Chula
Vista has heretofore approved that certain tentative map of a
subdivision to be known as Telegraph Canyon Terrace and has recom-
mended that the City Council approve said tentative map subject
to the conditions .contained in Planning Commission Resolution No.
PCS-78-7, adopted on the 28th day of June, 1978, a copy of which
is attached hereto and by this reference made a part hereof, the
same as though fully set forth herein, and
WHEREAS, the proposed project is exempt from environmental
review as a Class 1(i) exemption.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Chula Vista that said Council does hereby approve said
tentative subdivision map in accordance with Planning Commission
Resolution No. PCS-78-7; provided, however, that as a further con-
dition of approval, the Fire Department shall stipulate in writing
as to the adequacy of the circulation system proposed for said
subdivision.

RESOLUTION OF THE CITY PLANNING COMMISSION RECOf~IMENDING TO
THE CITY COUNCIL THE APPROVAL OF THE TENTATIVE SUBDIVISION
MAP KNOWN AS TELEGRAPH CANYON TERRACE
WHEREAS, J-Len, Inc., has submitted a tentative subdivision map
identified as Telegraph Canyon Terrace to subdivide 15.35 acres, located on
the south side of Telegraph Canyon Road, east of I-805 Freeway, into four
lots and to convert 152 apartment units into condominiums, and
WHEREAS, Section 66473.5 of the Government Code provides that approval
of a subdivision map shall be based upon findings of consistency between the
subdivision map and the adopted General Plan of the local jurisdiction, and
WHEREAS, the Planning Commission set the time and place for a public
hearing to consider said tentative map, and notice of said hearing, with its
purpose, was given by the publication in a newspaper of teneral circulation in
the city at least 10 days prior to the date of said hearing, and
WHEREAS, a hearing was held at said time and place, namely 7:00 p.m.
June 28, 1978 in the Council Chamber, City Hall, before the Planning Commission
and said hearing was thereafter closed, and
WHEREAS, the proposed project was determined to be exempt from environ-
mental review as a Class li exemption,
NOW THEREFORE BE IT RESOLVED AS FOLLOWS:
1. From facts presented to the Planning Commission, the Commission finds
that the subdivision map known as Telegraph Canyon Terrace is consistent with
the goals and objectives of the Chula Vista General Plan based on the following:
a. The conversion of the apartments into a condominium does not
affect the following elements of the General Plan: Land Use,
Circulation, Seismic Safety, Safety, Noise, Scenic Highways,
Bicycle Routes, Public Buildings, Conservation, Parks and
Recreation, and Open Space.
b. Housing Element - While the conversion of apartment units into
condominiums will reduce the inventory of rental housing, it
will also permit an expanded choice of housing ownership.
~ 2. The Planning Commission recommends to the City Council that Tentative
Map PCS-78-7 for Telegraph Canyon Terrace be approved, subject to the following
conditions:
a. The right-of-way dedication on Telegraph Canyon Road between
Oleander Avenue and the easterly subdivision boundary line shall
be 63 feet south of the centerline, "N" line of Telegraph Canyon
Road.

b. The subdivider shall be responsible for installing full ultimate
improvements for the south half of Telegraph Canyon Road from
Halecrest Drive to Paseo del Rey. The improvements shall include
but not be limited to curb, gutter, sidewalk, pavement, one-half
of the 14 foot median island west of Oleander and one-half of
the 16 foot median island east of Oleander complete with left-
turn storage, drainage facilities, street lights, traffic signal
facilities and street trees.
c. The subdivider shall be responsible for installing full ultimate
improvements in Oleander Avenue. The improvements shall include
but not be limited to driveway approaches, modification and
construction of drainage facilities, street trees and street
lights.
d. The developer shall agree to be included in an assessment
district or reimbursement district, if formed, for improvement
of Telegraph Canyon Road and adjoining drainage channel.
e. An 8 foot easement for street tree planting and maintenance
along both sides of Oleander Avenue and on the south side. of
Telegraph Canyon Road shall be granted to the City of Chula
Vista. The developer shall plant trees along dedicated streets,
the number and species to be determined by the City Engineer.
f. The developer shall be responsible for relocation of equipment
for the traffic signals along the south side of Telegraph
Canyon Road at Oleander Avenue. The traffic standard at the
southeast corner of Oleander Avenue shall be replaced with a
type 19 mast arm. The developer shall also be responsible
for loop installation in the third land of Telegraph Canyon
Road and repair to existing loops which may be damaged during
grading operations.
g. The developer shall pay the sewer connection charges for Telegraph
Canyon sewer trunk repayment agreement.
h. All utilities serving the subdivision shall be undergrounded.
i. The developer shall comply with applicable sections of the Chula
Vista Municipal Code in effect at the time the tentative map is
approved by the City Council. Final map and improvement plans
shall be done in accordance with the Subdivision Manual.

j. The developer shall be required to pay the difference in
the Residential Construction Tax fee for condominiums in
excess of the fee for apartment units, as set forth in
the adopted fee schedule approved by the City of Chula
Vista.
3. That this resolution be transmitted, along with the Tentative Map,
to the City Council, and a copy of this resolution be transmitted to the
applicant.
