A. BACKGROUND
1. The applicant has submitted a tentative subdivision map for Park Way Villas for
the purpose of converting an approved 10 unit apartment project into a one lot condominium
project. The building is under construction on a 15,050 square foot parcel located at
575 Park Way in the R-3 zone.
2. This project is exempt from environmental review as a class 1(k) exemption.
B. DISCUSSION
1. Existing site characteristics,
The site is a 50'x301' vacant parcel which was previously occupied by a single family
dwelling. The property is relatively level, sloping gently from the rear toward the
street. In May, 1978, the Design Review Committee approved the plans for a 10 unit two-
story apartment project on the site. The units are presently under construction.
2. Code requirements.
a. The development meets all of the minimum requirements of the zoning and
building codes and the Design Review Manual. The conversion requires .the subdivider to
pay the difference between the residential construction tax for apartments and condominiums
which is $100 per unit or a total of $1,000.
b. It should be noted that although the subdivision meets the present requirements
of the Municipal Code and the Design Review Manual, it does not meet two provisions of the
proposed condominium conversion ordinance presented to the City Council on September 5, 1978.
These provisions are: an enclosed private storage area measuring 8'x8'x8' (512 cu.ft.),

STAFF RECOMMENDATION
Concur with the Planning Commission recommendation, and recommend that the following
condition be added to the approval of the tentative map:
"111 requirements of any condominium conversion ordinance in effect at the time the
final map is before the Council shall be fulfilled or such fulfillment secured to
the satisfaction of the Council."
BOARD/COMMISSION RECOMMENDATION
On August 23, 1978 the Planning Commission voted 5-0 (with 2 members absent) to
recommend approval of the tentative subdivision map for Park Way Villas in accordance
with Resolution PCS-79-2.

and separate utility meters for each unit. It cannot be determined at this time whether
these two requirements will ultimately be part of the final adopted ordinance, therefore
the tentative map should be approved subject to a condition that final map approval is
subject to complying with the condominium ordinance in effect at that time.
3. Tentative subdivision map.
The one lot tentative subdivision map has been prepared and submitted to comply with
the State Map Act requirement for the conversion of apartments containing five units or
more into condominium ownership.
