BACKGROUND 1. The applicant has submitted a tentative subdivision map for Skyview Condominiums for the purpose of constructing a 21 unit condominium complex at 467-469 Fourth Avenue in the R-3 zone. 2. The project is exempt from environmental review as a class 1(k) exemption. B. DISCUSSION 1. Existing site characteristics. The subject property consists of two parcels containing 0.77 acres and is presently developed with a single family dwelling and a duplex. On June 22, 1978 the Design Review Committee approved a plan for a 21 unit, three story apartment project for the two parcels. The existing structures will be removed from the property. 2. Code requirements. a. Inasmuch as the apartments area recently approved project, the development meets all of the present Code requirements relating to parking, open space, private balconies and patios, unit size, and lot coverage. Construction will be in accordance with the present Uniform Building Code. The applicant is required by Code to file with the City a copy of the CC&R's naming the City as a party to said Declarations and author- izing the City to enforce same. In addition, the developer will be required to pay the difference in the residential construction tax for apartments and for condominiums, which is $100 a unit, or $2,100 total. It should be noted that although the subdivision meets the present require- ments of the Municipal Code and the Design Review Manual, it does not meet two provisions of the proposed condominium conversion ordinance presented to the City Council on September 5, 1978. These provisions are: an enclosed private storage area measuring 8'x8'x8' (512 cu.ft.), and separate utility meters for each unit. It cannot be determined at this time whether these two requirements will ultimately be part of the final adopted ordinance, therefore the tentative map should be approved subject to a condition that final map approval is subject to complying with the condominium ordinance in effect at that time. 3. Tentative subdivision map. The tentative subdivision map has been prepared and submitted in compliance with the State Map Act requirement for the conversion of an apartment project containing five units or more into condominium ownership. ~' 2 (~ ~ RESOLUTION N0. PCS-79-4 RESOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING TO THE CITY COUNCIL THE APPROVAL OF THE TENTATIVE SUBDIVISION MAP FOR SKYVIEW CONDOMINIUM WHEREAS, South Bay Development has submitted a tentative subdivision map for Skyview Condominium to convert a 21 unit apartment project on 0.77 acres into a one lot condominium at 465 Fourth Avenue in the R-3 zone, and WHEREAS, Section 66473.5 of the Government Code provides that approval of a subdivision map shall be based upon findings of consistency between the subdivision map and the adopted General Plan of the local jurisdiction, and WHEREAS, the Planning Commission set the time and place fora public hearing to consider said tentative map, and notice of said hearing, with its purpose, was given by the publication in a newspaper of general circulation in the city at least 10 days prior to the date of said hearing, and WHEREAS, a hearing was held at said time and place, namely 7:00 p.m., August 23, 1978 in the Council Chamber, City Hall, before the Planning Commission and said hearing was thereafter closed, and WHEREAS, the proposed project was determined to be exempt from environ- mental revie~v as a Class 1(k) exemption. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. From facts presented to the Planning Commission, the Commission finds ~~ that the subdivision map known as Skyview Condominium is consistent with the goals and objectives of the Chula Vista General Plan based on the following: a. The conversion of apartments into a condominium does not affect the following elements of the General Plan: Land Use, Circulation, Seismic Safety, Safety, Noise, Scenic Highways, Bicycle Routes, Public Buildings, Conservation, Parks and Recreation, and Open Space. b. Housing Element -,While the conversion of apartment units into condominiums will reduce the inventory of rental housing, it will also permit an expanded choice of housing ownership: Since this project has not been constructed the conversion does not effect ' the inventory of apartments available. 2. The Planning Commission recommends to the City Council that Tentative Map PCS-79-4 for Skyview Condominium be approved. ~'` 3.
