The last two Federal Aid Urban (FAU) Highway Programs have resulted in
approximately six to eight million dollars per year being distributed
to local and state agencies in San Diego County for the improvement of
highways and transit facilities.
On the one hand, this has been a good and productive program for local
agencies and has helped to lessen the impact of inflation on the
relatively stable State Gas Tax apportionments by providing extra
money for construction. On the other hand, Federal regulations for the
expenditure of FAU funds are very cumbersome and time delaying. For
instance, it took nine (9) months for Chula Vista to receive plan
approval for a traffic signal project. Projects using gas tax funds do
not require approval from other agencies and this nine (9) month time
delay would not have occurred.
In an effort to shorten the process and eliminate the long delays that
most local agencies have experienced in processing the plans and speci-
ficcations, the San Diego Federal Aid Urban Advisory Committee is
requesting that CALTRANS give the cities and local agencies gas tax funds
in exchange for the Federal Aid Urban funds. All the local agencies are
familiar with the requirements for the gas tax funding and would be
able to process projects much simpler and quicker than with using FAU
funds. On the other hand, CALTRANS is quite familiar with using Federal
funds and, in fact, goes through much of the same paper work and
processing procedures for all of their gas tax projects and Federal Aid
Interstate projects as they do for their Federal Aid Urban projects.
Therefore, the Committee believes that exchanging Federal Aid Urban
funds for gas tax funds would streamline the process for local govern-

selection procedures would not change. Therefore, the intent of the
Federal Aid Urban Program in urban regions would still be intact. The
only difference with this procedure would be that the design and
construction process would be shortened.
CALTRANS has informed us that due to the State code, this procedure
would not be allowable unless a change were made to the State code.
Therefore, the Committee has developed a proposed statute change which
would make "washing" of Federal Aid Urban funds legal. Even with the
statute change, we will still need the approval of CALTRANS and the
ability to wash funds would be based upon CALTRANS availability of
funds, and agreements between local agencies and CALTRANS for this
process. This Resolution merely urges the State legislature to change
the State code so that the exchange of funds would be legal.
