N0~) A. BACKGROUND 1. The applicant has submitted a tentative subd vison map for the La Bonita Apartments to subdivide the 6,3 acre property into 2 lots for the conversion of 108 apartment units into condominiums at 4075-4201 Bonita Road in the R-3-G-D zone 2. The proposed project is exempt from environmental review as a Class 1(k) exemption. B. DTSCUSSION 1. Adjacent zoning and land use: North A-D-F Golf Course South C-C-D Commercial shopping center East R-3-G-D-F Apartments West C-C-D Commercial 2. Existing site characteristics The subject property consists of two level parcels totalling 6,3 acres. The westerly parcel is developed with 64 units and 95 offstreet parking spaces and the easterly lot is developed with 44 units and 72 parking spaces. A portion of the parking on each parcel is located within carports located adjacent to the street. At the time of construction, the sites were raised one foot above the 100 year flood level. 3. Tentative subdivision map The tentative subdivision map will maintain the present lot size and configuration of KGL:hm EXN I B ITS (continued on su Ordinance Plat 1 Agreement Resolution(, 8 Notification List Res.PCS-78- Other Tent.Map ENVIRONMENTAL DOCUMENT: Attached Submitted on FINANCIAL IMPACT STAFF RECOMMENDATION Concur with Planning Commission recommendation. BOARD/COMMISSION RECOMMENDATION On July 12 the City Planning Commission voted 5-1 (with one member absent) to recommend approval of the tentative subdivision map for La Bonita in accordance with Resolution PCS-78-8. A tentative subdivision map has been submitted to comply with the State Map Act which requires the submittal and approval of a tentative map for the conversion of apartment units containing five units or more into condominium ownership. 4. Requirements In addition to the recommended conditions of approval the developer will be required to fulfill the following ordinance requirements. a. Each of the tenants of the proposed condominium project shall be given 120 days written notice of the intention to convert prior to termination of tenancy. Evidence of delivery of the written notice shall be submitted to the Director of Public Works prior to approval of the Final Map. b. Each of the tenants of the proposed condominium project shall be given written notice of exclusive right to contract for the purchase of their respective units. Evidence of the delivery of said written notice shall be submitted to the Director of Public Works prior to approval of the Final Map. c. The developer will be required to pay the residential construction tax fee for condominiums as set forth in the schedule adopted by the City of Chula Vista. d. The subdivider shall file with the City a Declaration of Covenants, Condi- tions and Restrictions, naming the City of Chula Vista as a party to said Declaration in the same manner as any owner within the subdivision. Said Declaration shall be subject to approval of the City Council concurrent with approval of the Final Map. 931
