A. BACKGROUND
This item was continued from the City Council meeting of August 1 so that Council would
have an opportunity to consider an appropriate city policy for the regulation of the
conversion of apartments to condominiums..
B. DISCUSSION.
1. As the Council Conference on the conversion of apartments to condominiums is
scheduled after the due date for preparation of reports to Council, this report will
not address that question. Depending upon the outcome of the Council Conference, an
oral report may 6e appropriate at the August 15 Council meeting..
2. Questions also arose at the August 1 meeting as to whether the existing apart-
ment complex complies with current zoning and building codes. The. remainder of this
report will address those questions..
3. The La Bonita apartment complex was constructed at two different times. The
easterly 44 units were built approximately 14 years ago and the remaining 64 units about
5 years ago. The various city ordinances applicable to the site have changed substan-
tially since the first units were built; however, the zoning ordinance requirements are
essentially the same as they were five years ago, with the exception of the requirement
for private balconies and patios. The following table represents a comparison between
the zoning regulations and the existing conditions.

Exceeds minimum requirements
In addition it should be noted that the development also has three recreation buildings
and 2 pools, although one of the pools is not operating. The overall density is slightly
less than the code permits (17.1 units/acre versus 17.4 units/acre).
4. Building code compliance.
The Building Department indicates that the buildings comply with the present code
with the possible exception of noise attenuation and energy regulations.
a) The units were not required to meet a specific sound transmission requirement
when they were constructed. The present standards require that a minimum
32" batten material be placed between separating walls and ceilings, with
field testing and certification to achieve a maximum reading of 45 dBA`s
within the dwelling units. While the existing units were constructed
using a 3%2 batten between units, no field testing was accomplished. There
are some other requirements now in effect regarding location of pipes and
construction techniques on electric outlets which reduce sound transmission
that probably were not employed in the construction of the La Bonita apartments.
b) The energy regulations recently adopted limit the maximum window area to
16% of the total floor area, whereas previously 20% was allowed. It is
possible that these units do not comply with the 16% maximum. However,
this can best be determined by taking the appropriate measurements in each
unit. For purposes of this report such measurements were not made.
5. Conclusion.
The La Bonita apartments essentially conform to the requirements of the zoning
ordinance. The apartments probably do not comply with present building codes but this
can only be finally determined after considerable on-site measuring and testing.
