BACKGROUND 1. The applicant has submitted a tentative subdivision map to divide a 3.00 acre parcel located on the west side of Melrose Avenue, 150 feet south of Otay Valley Road, into 51 lots. The proposed development will be a 50 unit condominium project. B. DISCUSSION 1. Tentative parcel map.. The subject property is part of a 4.33 acre parcel for which a tentative parcel map (P. M.-78-10) has been submitted and approved to divide the property into three lots. This tentative subdivision map is for the further division of one of the parcels of the parcel map which has not been recorded as of this date. The final parcel map will have to be recorded prior to the recordation of this subdivision map. It is also noted that the dimensions and lot configuration shown on the earlier parcel map do not coincide with the proposed subdivision map and, therefore, the subdivision map will have to be revised to comply. 2. Tentative subdivision map. The developer proposes to residential lots approximately held in common ownership. BOARD/COMMISSION RECOMMENDATION On May 10 the Planning Commission voted 7-0 to recommend approval of the tentative subdivision map for Vista De Otay in accordance with Resolution PCS-78-6, COUNCIL ACTION Item No. 10, l0a For meeting of 6/6/78 Supplemental Page 2 construction of 12 fourplex and one duplex unit on just over 3/4 of an acre of land, leaving the remaining area of nearly 2-1/2 acres for parking and common open space. PCS-7~-6 RESOLUTION OF THE CITY PLA~JNING COMMISSIOfd RECCM~~IENDING TO THE CITY COUNCIL THE APPROVAL OF TENTATIVE SUCDIVISIOid MAP KNO!~JN AS VISTA DE OTAY WHEREAS, the applicant has submitted a tentative subdivision map to divide a 3.00 acre parcel located on the west side of h1elrose Avenue, 150 feet south of Otay Valley Road, into 51 lots. The proposed development will be a 50 unit condominium project, and WHEREAS, Section 66473.5 of the Government Code provides that approval of a subdivision map shall be based upon findings of consistency between the subdivi- sion map and the adopted General Plan of the local jurisdiction, and L~JHEREAS, the Planning Commission set the time and place fora public hearing to consider said tentative map, and notice of said hearing, with its purpose, was given by the publication in a newspaper of general circulation in the City at least 10 days prior to the date of said hearing, and WHEREAS, a hearing ~~~as held at said time and place, namely 7:00 p.m., P~1ay 10, 1978 in the Council Chambers, City Hall, before the Planning Commission and said hearing was thereafter closed, and tJHEP,EAS, on ~~lay 10, 1978 the Planning Commission adopted and certified Environmental Impact Report EIR-76-11 for this project. NOt~J THEREFORE BE IT RESOLVED AS FOLLOWS: From facts presented to the Planning Commission, the Commission finds that the subdivision map known as Vista De Otay is consistent with the General Plan for the City of Chula l'ista as follo~vs: 1. Land Use Element - High density residential developments are permitted in the commercial areas when the mixture of the two uses results in a compatible and harmonious development. 2. Circulation Element - No streets are shown through the subject property. 3. Housing Element - The proposed project will increase the housing inven- tory in the City of Chula Vista. The developer has applied to FHA and VA for loan guarantees in order to provide housing for moderate income persons. because of the projected costs, it is unlikely that lo~~~ income families ~~~ill qualify. 4. Conservation Element - The site is void of any significant vegetation or ~,~ildlife, and has no historical significance. PCS-78-6 Cont'd Page 2 5. Open Space and Parks and Recreation Elements - The proposed development will be required to contribute toward the acquisition and improvement of park land ~.vithin the area. The project will also contain its o~vn private open space. 6. Seismic Safety Element - There are no known geological hazards on the property. The proposed development will not encroach into the drainage area to the west. 7. Safety Element - The developer will install a fire hydrant at each drivetivay entrance and the turnaround at the end of each driveway will help facilitate internal circulation for emergency vehicles. 8. Noise Element - The proposed development will be screened from the anticipated high volumes of traffic on Otay Valley Road by future commercial development. 9. Scenic High~~~ay Element - The subject property is not adjacent to any designated scenic routes. 10. Bicycle Routes Element - No designated bike routes are proposed on Melrose Avenue. 11. Public Buildings Element - No public buildings are proposed on the subject property. The Planning Commission recommends to the City Council that Tentative Map PCS-78-6 for the Vista De Otay subdivision be approved, subject to the following conditions: 1. The owner shall grant to the City an easement for street tree planting and maintenance along the easterly line of the subject property. The owner may be required to supplement the street tree planting along Melrose Avenue in the subject property. The species and number of trees shall be determined by the Director of Public Glorks. 2. All electrical, communication, CATV and similar distribution service wires and/or cables shall be placed underground. 3. The owner shall comply with all applicable sections of the Chula Vista f~unicipal Code prior to approval of the final map. The final map shall be prepared in accordance with the Subdivision Manual of the City of Chula Vista. PCS-78-6 Cont'd Page 3 4. The subdivider shall file urith the City a Declaration of Covenants, Conditions and Restrictions naming the City of Chula Vista as a party to said Ceclaration and authorizing the City to enforce terms and conditions of the Declaration in the same manner as any o~:aner ~.vithin the subdivision. Said Declaration shall be subject to approval of the City Council concurrent ~•~ith approval of the final map. 5. The developer shall be obligated for park fees based upon Ordinance -1668. The fee consists of 5100 per unit development cost plus the market value of 272 sq. ft. of land per unit, or 272 x 50 = 13,600 sq. ft. 6. T~vo fire hydrants will be required, one at each driveway entrance as indicated on the plan. Fire hydrants shall have one 4" outlet and t~vo 2-1/2" outlets. Required fire flo~•~ shall be 1,500 gpm, 2,000 gpm if blood shingle roofing is used, for a duration of 5 hours, based upon a minimum flow of 20 psi residual operating pressure in the street main from which the flow is measured. 7. The final subdivision map shall not be recorded until Parcel Map 78-10 is recorded. The subdivision lot area and dimensions shall be the same as Parcel 3 of Parcel Map 78-10. 8. The boundaries of the residential lots shall be adjusted io include the ground level patio area within the area of each lot. 9. The Final Parcel ~•tap for Tentative Parcel P1ap 778-10 shall record with the San Diego County Recorder prior to approval of the Final Pap for Vista de Otay Subdivision by the Chula Uista City Council. All conditions imposed upon Tentative Parcel Map 777-10 shall be satisfied prior to approval of the Final Map of Vista de Otay Subdivision by the Chula Vista City Council. 10. Streets - Drivetivay approaches within ~~lelrose Avenue shall be constructed in accordance t~~ ith City of Chula Vista Standards and Specifications. The drive- ways and parking lots serving Vista de Otay Subdivision shall be constructed in accordance with Chula Vista Standards and Specifications. 11. Se~•~ers - the 6" sewer mains as shown on the Tentative Map serving Vista de Otay Subdivision shall remain private and shall be maintained by a Homeo~•mers' Association Evidence shall be submitted to the City Engineer that a Homecr~ners' Association has been established for maintaining the private sewer main and laterals ~•lithin the Subdivision prior to the approval of the Finai PCS-7°-6 Cont'd Page 4 htap by the Chula Vista City Council. If the on-site sewer mains serving the development are to be public and to be maintained by the City, the sewer main shall be increased in size to an 8" se~.ver main. Also, manholes shall be con- structed at the terminus of these t~vo sever mains on site if they are to be public and maintained by the City. The owners will dedicate easements for an 8" sewer. The developer shall pay a sewer connection charge of $65.00 per dwelling unit plus interest for the Date Favor Sewer Repayment District and a 570.00 per gross acre area charge to the Plontgomery Sanitation District for any connection to the sewer main along Melrose Avenue prior to approval of the Final Map by the Chula Vista City Council. 12. Utilities -Utilities serving the Subdivision shall be undergrounded. 13. Grading - The owner shall obtain a Land Development Permit and approved grading plans for any grading done in accordance with Section 1504 of the Chula Vista flunicipal Code. Grading plans shall be approved by the City Engineer prior to approval of the Final f~1ap by the Chula Vista City Council. 14. Traffic Signals - The developer shall be responsible for paying his proportionate share of the cost for the installation of the traffic signal at the intersection of Otay Valley Road and flelrose Avenue. The developer shall make a cash bond deposit for his proportionate share of the traffic signal prior to the approval of the Final flap. 15. General - The owner/developer shall comply with all applicable sections of theChula Vista f~lunicipal Code prior to approval of the Final h1ap. The Final Map, Improvement Plans, and Grading Plan shall be prepared in accordance ~vith the Subdivision Manual of the City of Chula Vista.
