A. BACKGROUND
1. The applicant has submitted a tentative subdivision map, Touch of Spain, in
order to convert a 16 unit apartment project into condominiums at 383 Mankato Street
in the R-3 zone.
2. The proposed project is exempt from environmental review as a Class Vii:
exemption.
B. DISCUSSION
1. Subdivision Map Act.
The State Subdivision Map Act requires the submittal and approval of a
tentative subdivision map for the conversion of apartments into condominium ownership.
2. Adjacent zoning and land use.
North R-3 Single family dwellings
South R-3 Single family dwellings
East R-3 Day nursery
West R-3 Lion's Club
3. Existing site characteristics.
The subject property is a level 0.4 acre parcel (113' x 151') which is
developed with 16 apartment units, consisting of three two-story structures. There

are two 4 unit structures in front and one 8 unit structure in the rear with 11
carports located underneath the 8 unit complex. In addition, there are 10 open
parking spaces located along the rear property line. Access to the parking is
by way of a 20 ft. wide improved alley located on the west side of the property.
4. Planning Commission meeting
At the Planning Commission meeting, several residents of the apartments
stated that they had not been notified of the conversion and objected to the
changes to condominiums (see attached Planning Commission minutes).* Some of
the Commissioners also expressed concern over the trend to more conversions.
However, it was noted by the Assistant City Attorney that little discretio-s is
given to the City in these matters. Approval was granted based on the findings
contained in the attached resolution. Under the present Procedures and Regulations
staff is obligated to recommend approval of the map as long as it meets the pro-
visions of the State Map Act and local regulations.
* The Commission asked the staff to explore the possibility of making sure
that the occupants of apartments proposed for conversion be notified of
the Public Hearing. The Commission also expressed a need to more closely
regulate the conversion of apartments to condominium units.

Gentlemen:
I wish to take this opportunity to thank you gentlemen
for your kind indulgence in listening to my plea to halt
the conversion of the above apartment complex into
condominiums.
However, in my anxiety and alloted time, I failed to inform
you of the hardship it would really impose on other elderly
tenants in this complex.
Of the sixteen units in this building, nine are occupied by
senior citizens, living on fixed incomes. Of tkle nine, three
are receiving aid from H.U.D. (Housing and Urban Development).
One tenant, whose husband is going blind move3in dust 45 days
before receiving a notice of said conversion.
I think it is unfair for the City to allow a building ten
to twelve years old to be converted and sold as condominiums.
It is not only unfair to the people living in the co~iplex at
present, but more unfair to perspective buyers, because they
are the owes who are being "ripped off".
Therefore, I feel that at this place in time the Council
should take into consideration that by granting this conversion
you are setting a president to allow other mercenary apartment
owners to get on the " Money Wagon '~.
Gentlemen, I bane been a salesman almost all of my working
years and feel in my heart I know a sincere and honest face
when I see one. Having stood before you, I went away with a
feeling that even if I lose my cause, we, the elderly tenants
will know we were dealt with fairly.
