Consequently, the outlook for beautification of that portion of I-805 between Bonita Road and Naples Street has been poor. However, the Chula Vista Chamber of Commerce, working with CALTRANS, has developed a community project designed to beautify I-805 freeway between "H" Street and Bonita Road. While this segment of the freeway is not within the City, it is generally considered to be an entrance to the City and its shopping centers by the traveling public. Under the plan, the Chamber would undertake to provide the necessary low maintenance plant materials without cost to the State and CALTRANS would provide funds to plant and maintain those materials within the freeway right-of-way. The concept involves more than a simple ?~eautification effort. It will also provide a basis of experience for CALTRANS in the use of drought-resistant, low-maintenance plant materials. Consequently, this pilot project offers the potential of reduced maintenance costs for freeway landscaping throughout Southern California. As such, it would permit the limited funds available to beautify a greater length of freeways. The necessary plant materials are being donated through the Chamber. Staff is advised by the Director of the Chamber that all plant materials are either on hand or will shortly be available. CALTRANS has expressed an interest in the project through their preparation of the basic agreement between the City and CALTRANS. City involvement arises because CALTRANS is not permitted to enter into agreement with a private organization (i.e. Chamber of Commerce) for work of this WEH: h EXHIBITS (continued on supplemental paae) Agreement) Resolution X Ordinance Plat Notification List Other ENVIRONMENTAL DOCUMENT: Attached Submitted on FINANCIAL IMPACT No financial impact is foreseen other than the expense of preparing and processing the subject agreements. In the event of non-performance by the Chamber, the City would be liable for CALTRANS expense in pur- chase of shortfall plant materials. Maximum liability is $2,500.00. STAFF RECOMMENDATION If City Council determines it appropriate to ~~rovide non-reimbursable assurance of Chamber performance, then it is recommended that.the Council adopt Resolutions (A) and (B) approving separate agreements with the Chamber of Commerce and CALTRANS. Consequently, the City has been requested to act as a middleman and execute separate agreements with each of the two named agencies. The two agreements are interdependent and must be jointly approved or disapproved. City/Chamber Agreement - Item A 1. Specifies numbers and types of plant materials to be supplied by Chamber. 2. Specifies Chamber responsibility for plant maintenance until delivery to CALTRANS. 3. Specifies City commitment to enter into agreement with CALTRANS. 4. MAKES NO PROVISION for reimbursement to City for expenses in purchasing plant materials not provided by Chamber per agreement. City/CALTRANS Agreement - Item B 1. Specifies numbers and types of plant materials to be supplied by City (as provided by Chamber per City/Chamber agreement). 2. Specifies City responsibility for plant maintenance until de- livery to CALTRANS. 3. Specifies CITY OBLIGATION TO REIMBURSE CALTRANS for expenses in purchasing plant materials not provided by City per agree- ment up to a maximum amount of $2,500.00. The agreements are in general complementary. However, it must be noted that the City would become financially obligated to CALTRANS in the event that the Chamber failed to meet its contractual obliga- tions. Conversely, the Chamber would have no such obligation to the City. NOTE: The City/Chamber agreement as originally submitted to the Chamber included a clause for reimbursement to the City for pur- chase of plant materials not provided by the Chamber. However, the Chamber expressed an unwillingness to execute the agreement unless that provision was deleted. CALTRANS representatives insist that reimbursement provisions be included in the City/CALTRANS agreement. If the Chamber provides all of the plant material per the agreement, there will be no di- rect expense to the City. A representative from the Chamber will be at the meeting to answer questions which the Council may have.
