RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA AUTHORIZING A RECORDS DESTRUCTION
PROCEDURE FOR POLICE RECORDS
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the City of Chula Vista is in need of a police
records destruction procedure as prescribed by law, and
WHEREAS, Government Code Section 34090 provides that the
head of a city department may destroy certain city records,
documents, or instruments under his charge, without duplication,
with approval of the City Council by resolution and with the
written consent of the City Attorney, and
WHEREAS, it has been determined that certain records are
no longer required for retention and an accumulation of police
records has become unduly cumbersome.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Chula Vista that the following schedule for the
continuous purging and destruction of police records is hereby
established:
A. The following records will be retained for one
hundred (100) days and then may be subsequently
destroyed:
Recordings of telephone and radio communications
maintained by the Chula Vista Police Department, as
long as such recordings are not evidence in any
claim filed or pending litigation.
B. The following records will be retained for two (2)
years and then may subsequently destroyed:
1. Pawn slips.
2. Field Interviews.
3. Traffic and Misdemeanor Citations.
4. Dispatch, Locator Cards.
5. Crime Case Log.
6. Juvenile Register.
7. Officers Daily Logs.

8. Detective Crime Case Assignment Logs.
9. Misdemeanor Marijuana Possession.
10. Traffic Collision Reports and associated
documents.
C. The following records will be retained for three (3)
years and subsequently destroyed:
Daily Logs
D. The following records will be retained for seven (7)
years and subsequently destroyed:
1. Felony Arrest Reports.
2. Misdemeanor Arrest Reports.
3. Felony Crime Cases.
4. Misdemeanor Crime Cases.
5. Miscellaneous Incident Reports.
6. All documents associated with 1 through 5
above, including but not limited to Master
Alpha Index Card Files.
E. The following records will be retained until their
expiration date and subsequently destroyed:
1. Sex Offender Registration, for life or for 100
years.
2. Narcotic Offender Registration, until
expiration set by court.
3. Arson Offender Registration, until expiration
set by court.
4. Bicycle licenses issued by the City of Chula
Vista.
BE IT FURTHER RESOLVED that the records specified above
do not include any documents related to citizen complaints or
investigations in response to citizen complaints relating to
members of the police department to internal affairs
investigations files, to capital crimes, embezzlement of public
funds, bribery of public officials nor unresolved missing persons
reports.

BE IT FURTHER RESOLVED that the written consent of the
City of Chula Vista City Attorney to the continuous purging and
destruction of the records enumerated in this resolution is
hereby incorporated and attached as "Exhibit A".
BE IT FURTHER RESOLVED that the Chief of Police is
hereby authorized to destroy the records described hereinabove.

SUBJECT: Destruction of Police Department Records Departmen~ Records
This office has reviewed the request for destruction of records
described in the foregoing resolution. This is nn requirement
under the law that we retain these records and Government Code
Section 34090 describes the procedure by which we may destroy
these no longer needed rocords. It requires written consent by
the City Attorney and approval by the City Council. By this
writing, the City Attorney consents to the destruction of these
records.
