RESOLUTION NO. 9118 F.SOLUTION OF TiiE CITY COUNCIL OF THE CITY OF HULA VISTA APPROVING THE TENTATIVE P'!AP OF A UBDIVISION TO BE KNOWN AS TOUCH OF SPAIN The City Council of the City of Chula Vista does hereby re olve a follows: WHEREAS, the Planning Commission of the City of Chula Vi to has heretofore approved that certain tentative map of a s devise n to be known as Touch of Spain and has recommended th t the ity Council approve said tentative map subject to th condi ions contained in Planning Commission Resolution No. PC -78-3, adopted on the 26th day of April, 1978, a copy of wh ch is ttached hereto and by this reference made a part he eof, t e same as though fully set forth herein, and ,WHEREAS, the proposed project is exempt from environ- me tal review as a Class li exemption. NO.J T EREFORE BE IT RESOLVED AS FOLLO:^JS: 1. Flom facts presented to the Planning Commission, the Commission finds that the subdivision map knoavn as Touch of Spain is consistent with thy: goals and objectives ~f the General Plan for the City of Chula Vista as follows: a} Housing Element - The conversion of apartment units into condominiums w 11 not reduce the inventory of available housing, The conversion will p rmit an expanded choice of ownership of housing, b Parks and Recreation Element - The developer is required to pay a c nversion tax avhich will be used to acquire and develop park lands to serve the residents of the development. c The conversion of the existing apartments into a condominium does n t affect the Land Use, Circulation, Seismic Safety, Safety, Noise, S enic Highways, Bicycle Routes, Public Buildings, or Conservation and O~en Space Elements of the General Plan. Map 2. Tie Planning Commission recommends to the City Council that Tentative PCS-78-'3 for Touch of Spain be approved, subject to the following conditions: a. Each of the tenants of the proposed condominium project shall be given 120 days written notice of the intention to convert prior to termination of tenancy. Evidence of delivery of the written notice shall :e submitted to the Director of Public ',forks prier to approval of the final map. b. Each of the tenants of the proposed condominiur~ project shall be given written notice or exclusive right to contract for the III, purchase of their respective unit. Evidence of the delivery of said •,vritten notice shall be submitted to the Director of Public !-forks prior to approval of the final map. c, The ot~:ner shall grant to the City an easement for street tree ', planting and maintenance along the southerly line of subject property. The otivner shall plant street trees along Mankato Street in subject property. The species and number of trees shall be determined by the Director of Public 4Jorks. d All electrical, communication, CATV and similar distribution service wires and/or cables shall be placed underground. e The owner shall comply ~•~ith all applicable sections of the Chula Vista Municipal Code prior to approval of the final map. The final map shall be prepared in accordance tivith the Subdivision Manual of i the City of Chula Vista. f'. The subdivider shall file tivith the City a Declaration of Covenants, Conditions and Restrictions naming the City of Chula Vista as a party to said Declaration and authorizing the City to enforce the terms and conditions of the Declaration in the same manner as any owner within the subdivision. Said Ceclaration shall be subject to approval of the City Council concurrent with approval of the final map. The developer shall pay the residential construction tax fee of `4500 based on the rate of $275 per unit plus X12.50 for each bedroom in excess of one per unit (8 two-bedroom units and 8 one-bedroom units). 3. 11hat this resolution be transmitted, along with the Tentative f~1ap, to th~ City Cq~uncil, and a copy of this resolution be transmitted to the applicant.
