RESOLUTION NO. 15181 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING FIRST AMENDMENT TO AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND CHARLES COSTA ENTERPRISES FOR THE OPERATION OF THE BAYFRONT VISITOR INFORMATION CENTERr AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT The City Council of the City of Chula Vista does hereby resolve as follows: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that that certain First Amendment to Agreement between THE CITY OF CHULA VISTA, a municipal corporation, and CHARLES COSTA ENTERPRISES for the Operation Of the Bayfront Visitor Information Center, dated the 18 day of July , 1989, a copy of which is attached hereto and incorporated herein, the same as though fully set forth herein be, and the same is hereby approved.~ BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista be, and he is hereby authorized and directed to execute said First Amendment to Agreement for and on behalf of the City of Chula Vista. CHULA VISTA VISITOR INFORMATION CENTER THIS FIRST AHENDMENT TO AGREEMENT Is entered into this the CITY OF CHULA ) Charles Costa Enterprises {hereinafter sLesseew). - WHEREAS, Charles Costa Enterprises was awarded a contract for operation of the Visitor Information Center for a three year period commencing Januax7 31, 1988, and WHEREAS, Charles Costa Enterprises, as the current operator, desires to.negotiate with the City an amendment to the existing contract to address issues which became evident only after several months of actual operation, and the City also desires to negotiate different services and potential for longer term withLessee. - NOW, THEREFORE, the par~ies agree as followst 1. Section 2 of the original contract shall be replaced by the followingt 2. Term. The term of this contract shall be for three (3) years, commencing January 31, 1988 and ending January 30, 1991 subject to the termination provisions ofthis agreement. Lessor has the option to extend the term of this contract in one (1) year increments for a maximum of three (3) additional years. 2., Section 3. of the original contract shall be replaced by the following= 3. Rent. A. During the Center's hours of operation, the rest rooms shall be available for public use. At least 60% of the total space avsileble for advertising on each side of said window end on each side of the display adver~ising panel shall be limited to visitor-related businesses located within the City of Chula Vista. A portable food stand placed in the v~nding machine ·re·. Operation of the food stand and ·11 other selling of food items'shell meet with ·11 applicable health regulstions. Said stand shall not be left unattended during the hours of operation end personnel attending the food stand shall not be counted for purposes of meeting the minimum staffing level specified in Section 6.B. Food items. permitted to be sold shall be limited to hot dogs, ·aches, chips, cookies, ice cream and cold drinks. E~uipment in this ares shall be limited to the following= (A) One hot dog stand no larger than 8' X 3-1/2' X 5' tall. (B) One ice cream container no larger than 4' X 4' X 4'. (C) One refrigerator no larger than 78' X 52' X # / (D) One refrigerator/freezer no larger than 78' X 52' X (E) One bread rack no larger than 6'.X 2-1/2' X 2'. (F) One candy display stand,no larger than 48' wide.by tall.
