RESOLUTION NO. 9266
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA APPROVING THE TENTATIVE MAP OF A SUBDIVISION

T~e City Council of the City of Chula Vista does hereby
ve as ollows:
W EREAS, the Planning Commission of the City of Chula
Vist has h retofore approved that certain tentative map of a
subd'vision to be known as Park Way Villas and has recommended that
the ity Co ncil approve said tentative map subject to the conditions
cont fined i Planning Commission Resolution No. PCS-79-2, adopted on
the 3rd da of August, 1978, a copy of which is attached hereto and
by t is ref rence made a part hereof, the same as though fully set
fort herei and
WHEREAS, the proposed project is exempt from environmental
revi w as a class 1(k) exemption.
N W, THEREFORE, BE IT RESOLVED by the City Council of the
City of Chu a Vista that said Council does hereby approve said
tent tive s bdivision map in accordance with Planning Commission
Reso ution o. PCS-79-4; provided, further that all requirements of
any ondomi ium conversion ordinance in effect at the time the final
map 's befo e the Council shall be fulfilled or such fulfillment
secu ed to he satisfaction of the Council.

WHE EAS, Section 66473.5 of the Government Code provides that approval of
subdivision map shall be based upon finc!ings of consistency between the sub-
vision p and the adopted General Plan of the local jurisdiction, and
WHE EAS, the Planning Commission set the time and place flora public
w ring t consider said tentative map, and notice of said hearing, with its
WHEREAS, David Eyres has submitted a tentative subdivision map for
Perk Way Villas to convert a 10 unit apartment project into a one lot condominium

p rpose, as given by the publication in a newspaper of general circulation in
t e city at least 10 days prior to the date of said hearing, and
WHE EAS, a hearing was held at said time and place, namely 7:00 p.m.,
A gust 23, 1978 in the Council Chamber, City Hall, before the Planning Commission

WHE EAS, the proposed project was determined to be exempt from environ-
m ntal re iew as a Class 1(k) exemption.
NObJ, THEREFORE, BE IT RESOLVED AS FOLLOWS:

1. From facts presented to the Planning Commission, the Commission finds
at the ubdivision map known as Park Way Villas is consistent with the goals
d objec fives of the Chula Vista General Plan based on the following:

~a. The conversion of apartments into condominiums does not affect the

following elements of the General Plan: Land Use, Circulation,
Seismic Safety, Safety, Noise, Scenic Highways, Bicycle Routes,
Public Buildings, Conservation, Parks and Recreation and Open

~b. Housing Element - While the conversion of apartment units into
condominiums will reduce the inventory of rental housing, it will
also permit an expanded choice of housing ownership. Since this
' building is presently under construction, the conversion does not
'I affect the existing inventory of apartments available.
The Planning Commission recommends to the City Council that Tentative
p PCS-79-2 for Park Way Villas be approved.
3. That this resolution be transmitted, along with the Tentative Map, to
e City Council, and a copy of this resolution be transmitted to the applicant.
