The construction of condominiums originally approved as an apart- ment project does not affect the following elements of the General Plan: Land Use, Circulation, Seismic Safety, Safety, Noise, Scenic Highway, Bicycle Routes, Public Buildings, Conservation, Parks and Recreation, and Open Space. a3o~ SOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING TO E CITY COUNCIL THE APPROVAL OF THE TENTATIVE SUBDIVISION P FOR MELROSE CONDOMIPJIUMS WHER AS, on July 14, 1978 American Building Arts submitted a tentative bdivisio map for the development of a two lot, 116 unit condominium project, td be know as h!elrose Condominiums, on 10.3 acres located in the R-3-P-12 zone ~ the nor h side of Otay Valley Road and on both sides of Melrose Avenue, and WHER AS, Section 66473.5 of the Government Code provides that approval of subdivision map shall be based upon findings of consistency between the ibdivisio map and the adopted General Plan of the local jurisdiction, and WHEREAS, the Planning Commission set the time and place fora public wring to consider said tentative map, and notice of said hearing, with its irpose, w s given by the publication in a newspaper of general circulation in ie city at least 10 days prior to the date of said hearing, and IJHEREAS, a hearing was held at said time and place, namely 7:00 p.m., ~ptember 13, 1978 in the Council Chamber, City Hall, before the Planning mmission and said hearing was thereafter closed, and WHE EAS, the proposed project was determined to be exempt from environ- ntal re iew as a Class 1(k) exemption. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. From facts presented to the Planning Commission, the Commission finds at the subdivision map known as Melrose Condominiums is consistent with the goals d objet fives of the Chula Vista General Plan based on the following: 2. M p PCS-75 tons: b. Housing Element - The construction of condominium units will permit an expanded choice of housing ownership. The Planning Commission recommends to the City Council that Tentative -1 for Melrose Condominiums be approved, subject to the following condi- a. Otay Valley Road shall be improved as a major street in accordance with the Chula Vista Design Standard CVDS-1. The improvement shall consist of but not be limited to monolithic curb, gutter and sidewalk 5.5 ft. in width, AC surfacing, street lights, street trees and underground utilities. The face of curb shall be 40 feet north of the center line. The developer shall dedicate additional right-of- way which shall be 48 feet from center line and an easement for street tree purposes. Melrose Avenue shall have a curb return radius of 30 feet at Otay Valley Road and sidewalk ramps: The developer shall dedicate street tree easements, 5.5 feet in width, on both sides of Melrose Avenue. The developer shall plant street trees along Melrose Avenue and Otay Valley Road. The number and species of trees being determined by the Director of Public Works. The surface drainage as shown on the map is subject to approval by the City Engineer. The drainage to be transported on private streets shall either be: (1) Curb and gutter per Regional Standard Drawing No. G-2; or (2) PCC Swale, 6" thick, and a width to be approved by the City Engineer. The developer shall be responsible for the construction of the drain- age channel (Poggi Canyon Channel) from the existing concrete channel at the northerly subdivision boundary to a suitable point downstream where the channel leaves the subdivision; point to be determined by the City Engineer. Existing concrete drainage channel adjacent to the subdivision shall be shown. All overhead utility lines shall be undergrounded. Utilities serving the subdivision shall also be underground. The developer shall be responsible for paying his proportionate share of the cost for the installation of the traffic signal at the intersection of Otay Valley Road and Melrose Avenue in accordance with the adopted City Council policy. The slope at the intersection of Melrose Avenue and Otay Valley Road shall be graded to allow for safe sight distance at the intersection. The developer shall comply with all the requirements of the Chula Vista Municipal Code as it pertains to this subdivision.
