HomeMy WebLinkAboutReso 1988-13871 RESOLUTION NO. 13871 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING TENTATIVE MAP FOR CHULA VISTA TRACT 88-9 The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, Mitchell N. Angus has submitted a tentative map proposal which would subdivide 1.32 acres into seven lots with a minimum lot size of 7,000 sq. ft. located on the north side of "C" Street, between Del Mar Avenue and Third Avenuet and WHEREAS, an Initial Study, IS-88-83, of potential environmental impacts associated with the implementation of the project was conducted by Environmental Review Coordinator on August 18, 1988, who concluded that there would be no significant environmental effects and recommended that the Negative Declaration be adopted, and WHEREAS, the Planning Commission voted unanimously to recommend that Council approve the tentative map in accordance with its Resolution PCS-88-9 adopted on the 24th day of August, 1988. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby approve the tentative map for Chula Vista Tract 88-9 subject to the following conditions: 1. The exterior sideyard setback adjacent to "C" Street on Lot 7 shall be 15 feet. 2. A decorative fencing program for the exterior sideyard on Lot 7 shall be submitted for staff review and approval prior to the issuance of building permits. 3. Should Lots 1-5 be rezoned to R-2, typical house/site plans shall be submitted for those lots subject to review and approval by staff prior to the approval of grading/improvement plans. 4. The subdivider shall reach agreement with the Chula Vista City School District and Sweetwater Union High School District with regard to adequate school facilities prior to approval of a final map. 5. The developer shall be responsible for the construction of full street improvements along the entire frontage of this project within a 20 foot "half street" in "C" Street north of a centerline which shall be located 2 feet south of the centerline as shown on the Tentative Map for this -1- subdivision. The developer shall also be responsible for the construction of full street improvements in the westerly half of Del Mar Street as shown on the Tentative Map. Said improvements shall be guaranteed prior to approval of the Final Map. 6. The developer shall retain a qualified soils engineer who shall determine the extent of the uncompacted fill located in "C" Street along the subdivision frontage, and shall make recommendations regarding methods of elimination or stabilizing the uncompacted soils. Said recommendations shall be incorporated in the construction of street improvements as required in Condition 5 above and may necessitate removal of existing improvements in "C" Street. The City shall pay 50% of the cost of this study upon submittal of an itemized invoice from the soils engineer. 7. The developer shall grant to the City 5-1/2 ft. street tree easements on the subject property along "C" Street and Del Mar Avenue. 8. Specific methods of handling storm drainage are subject to detailed approval by the City Engineer at the time of submission of improvement and grading plans. Design shall be accomplished on the basis of the requirements of the Subdivision Manual and the Grading Ordinance (#1797 as amended.). 9. Preparation of final plans shall be based on the City bench mark system. 10. Public sanitary sewer shall be extended to the northerly boundary of the subdivision and shall be constructed deep enough to serve the area northerly of the subdivision. 11. Sewers serving 10 or less equivalent dwelling units shall have a minimum grade of 1 percent. 12. Fire hydrants shall be installed adjacent to lots 2 and 7 subject to review and approval of the Fire Marshal. 13. The developer shall meet the requirements of Sweetwater Authority regarding water service and fire flow requirements prior to the approval of improvement plans. 14. Prior to Approval of the Final Map for this project the developer shall enter into an agreement with the City of Chula Vista and the South Bay Pioneers. This agreement shall provide for the design and construction of full-width improvements in C Street, including the facilities discussed in Condition 5 above. -2- BE IT FURTHER RESOLVED that the City Council does hereby - find that the project will not have any significant environmental impacts and does hereby adopt the Negative Declaration issued on IS-88-83.
