Section 3363.5 f the California Labor Code states: "Notwithstanding Sections 3351 and
3352, a person ho performs voluntary service without pay fora public agency, as designated
and aut orized y the governing body of the agency or its designee, shall, upon adoption of
a resol tion by the governing body of the agency so declaring, be deemed to be an employee
of the gency f r purposes of this division while performing such service."
At the November 16, 1978 Council Conference the City of Chula Vista Volunteer Program was
adopted to begi pilot operations in the Library and Parks and Recreation Departments.
The fir t volun eers to be selected under the program will begin work following
January 1, 1979 In order to assure that they will be covered in the case of injury
arising out of heir volunteer service, the Council must adopt a resolution declaring
the vol nteers o be employees for the purposes of Worker's Compensation coverage.
FINANCIAL IMP
There will not e a direct cost to the City unless a volunteer is injured. In the case
of an ilnjury, c st could be for medical expenses and income continuation if the volunteer
was employed el ewhere while volunteering for the City.
