RESOLUTION N0. 9400
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA ACCEPTING, DEDICATING AND NAMING .CERTAIN REAL
PROPERTY IN SAID CTTY FOR STREET AND HIGHWAY PURPOSES
LOCATED ON TELEGRAPH CANYON ROAD
The City Council of the City of Chula Vista does hereby
resolve as follows:
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Chula Vista that that certain grant of real property, made
by easement. , executed by Canyon Plaza Ltd., a limited partnership
dated the 9th day of June , 1978 , a copy of which
is attached hereto and by reference made a part hereof, the same
as though fully set forth herein be, and the same is hereby accepted
and dedicated to the public use for street and highway purposes by
the City of Chula Vista.
BE IT FURTHER RESOLVED that said real property is hereby
officially named TELEGRAPH CANYON ROAD
BE IT FURTHER RESOLVED that the City Clerk of the City
of Chula Vista beo and she is hereby authorized to record said
easement. in the office of the San Diego County Recorder.

The Grantor hereby further grants to the City of Chula.: Vista the privilege
and right to extend drainage structures and excavation and embankment slopes
beyond the limits of the herein described right-of-way where required for
the construction and maintenance of said public street. RESERVING unto
grantor of the above described parcel of land, his successors or assigns,
the right to eliminate such slopes and/or drainage structures or portions
thereof, when in the written opinion of the City Engineer of Grantee, the
necessity therefore is removed by substituting other protection, support
and/or drainage facility, provided such substitution is first approved in
writing by said City Engineer.
The Grantor hereby further grants to Grantee all trees, growths (growing
or that may hereafter grow),. and road building materials within said
right-of-way, including the right to take water, together with the right
to use the same in such manner and at such locations as said Grantee may
deem proper, needful or necessary, in the construction, reconstruction,
improvement or maintenance of said public street.
The Grantor, for himself, his successors and assigns, hereby waives any
claim fcr any and all damages to Grantor's remaining property contiguous
to the right-of-way hereby conveyed by reason of the location, construction,
landscaping or maintenance of said public street.

LEGAL DESCRIPTION
Beginning at the point of intersection of the Easterly line of
Halecrest Drive as shown on Halecrest Estates Unit A, according
to Map thereof No. 4339, filed in the Office of the County
Recorder of said County with the Northerly line of Telegraph
Canyon Road (Record of Survey 1086) as described in Deed to the
County of San Diego recorded August 13, 1957 in Book 6705, page
57 of Official Records; thence Easterly along said Northerly
line, along the arc of a 3250.00 foot radius curve, concave
Southerly through a central angle of 0°52'28" a distance of 49.60
feet; thence tangent to said curve, South 73°51'30" East, 80.10
feet to the TRUE POINT OF BEGINNING; thence Easterly, along said
Northerly line of Telegraph Canyon Road, South 73°51'30" East, 225.89
feet, to a point of tangency of 3950.00 foot radius curve, concave
Northerly; thence along the arc of said curve, through a central
angle of 10°25'00", a distance of 718.13 feet; thence tangent to
said curve, South 84°16'30" East, 563.12 feet to the Northwesterly
line of Crest Drive as described in that final Order of Condemnation
to the City of Chula Vista recorded March 10, 1971, as File No.
45736 in Book 1871 of Official Records, said point being a point
of Tangency on a 20 foot radius curve concave Northwesterly; thence
Easterly along the arc of said curve, through a central angle of
30°00'00", a distance of 10.47 feet to a point from which a radial
line bears North 24°16'30" West to the center of curvature; thence
continuing along said Northwesterly line North 5°43'30'' East, 13.00
feet to a point on a 20.00 foot radius curve, concave Northwesterly,
from which point a radial line bears North 24°16'30" West to the
center of curvature; thence Southwesterly along the arc of said curve,
through a central angle of 30°00'00" a distance of 10.47 feet;
thence, tangent to said curve, North 84°16'30" West, 563.12 feet
to a point of tangency on a 3937.00 foot radius curve, concave
Northerly; thence Westerly, along the arc of said curve, through a
central angle of 10°25'00" a distance of 715.77 feet; thence,
tangent to said curve, North 73°51'30" West, 225.89 feet; thence
South 16°08'30" West 13.00 feet to the TRUE POINT OF BEGINNING.
