RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA APPROVING THAT CERTAIN MEMORANDUP'I OF UNDER-
STANDING CONCERNING WAGES AND OTHER TERMS AND CONDITIONS
OF EMPLOYI~'IENT BETWEEN THE CITY OF CHULA VISTA AND THE
CHULA VISTA CHAPTER, WESTERN COUNCIL OF ErIGINEERS FOR
FISCAL YEAR 1978-79, AND APPROPRIATING FUNDS THEREFOR
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the Management Negotiation Team representing
the City Manager of the City of Chula Vista, acting for and on
behalf of the City Council of the City of Chula Vista, have
heretofore met and conferred with the Chula Vista Chapter, Western
Council of Engineers, an organization representing certain members
of classified employees in the City of Chula Vista, in accordance
with the provisions of Section 3500 et seq. of the Government
Code of the State of California, and
WHEREAS, the Memorandum of Understanding jointly pre-
pared by said parties as a result of meeting and conferring in
good faith has been presented to the City Council and is contained
in Exhibit "A", attached hereto and incorporated herein by ref-
erence as if set forth in full, and
WHEREAS, the additional annual cost of the compensation
package estimated to be $13,200 will require a special appropriation
of $11,440 to supplement the existing sum of $1,760 included in
the Fiscal 1978-79 Budget.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Chula Vista does hereby approve and accept said Memo-
randum of Understanding as contained in Exhibit "A" for Fiscal
Year 1978-79.
BE IT FURTHER RESOLVED that the sum of $11,440 be and
the same is hereby appropriated from the unappropriated balance
of the General Fund to be distributed as follows:

MEMORANDUM OF UNDERSTANDING CONCERNING WAGES AND OTHER TERMS AND
CONDITIONS OF EMPLOYMENT BETWEEN THE CITY OF CHULA VLSTA AND THE
CHULA VISTA CHAPTER, WESTERN COUNCIL OF ENGINEERS, FOR FISCAL
YEAR 1978-79
WHEREAS, the representatives of the City Manager of the City of Chula Vista, acting
for and on behalf of the City Council of the City of Chula Vista, have heretofore
met and conferred with the Chula Vista Chapter, 6Jestern Council of Engineers, an
organization representing the professional engineering classifications of Plan
Checker II, Associate Civil Engineer, Assistant Civil Engineer, and Junior Civil
Engineer, in accordance with the provisions of Section 3500 et. seq, of the Govern-
ment Code of the State of California.
WHEREAS, as a result of meeting and conferring in good faith with said group, agree-
ment has been reached on the following terms and conditions of employment as applied
to those classified employees who are members of, and represented by, said organiza-
tion and said representatives of the City of Chula Vista and of the Chula Vista
Chapter, Western Council of Engineers, do now jointly prepare a written Memorandum of
Understanding concerning said agreed terms and conditions of employment for presenta-
tion to the City Council of the City of Chula Vista for determination, to-wit:
PREAMBLE
This agreement is entered into by and between the City of Chula Vista, hereinafter
referred to as the City, and the Chula Vista Chapter, Western Council of Engineers,
hereinafter referred to as the Western Council.
It is the purpose of this Memorandum of Understanding to maintain and enhance harmonious
employment relations and effective communications between the City and the Western
Council, to provide for equitable and peaceful adjustments of the disputes and griev-
ances, and to establish proper standards of wages, hours and other terms and conditions
of employment.
City and 4Jestern Council agree to engage in a program designed to better serve the
citizens of Chula Vista by improving levels of service, reducing costs and/or
increasing revenues. All relations between the City and the Western Council shall
be conducted within the provisions of applicable City Charter sections and local
ordinances, and pertinent State or Federal laws and regulations.
RECOGNITION
The City recognizes the Western Council as a Certified Employee Organization and as
such the exclusive bargaining agent for all members of the classifications of Plan
Checker II, Associate Civil Engineer, Assistant Civil Engineer and Junior Civil Engineer.
I. Relationship Framework
The provisions of this section are included herein to provide explanatory informa-
tion agreed to be desirable by the parties. Nothing stated shall supersede the
c;ty's Employer-Employee Relations Policy nor in any way affect the rights of the
City under applicable local, State or Federal law.

A. Dues Deduction - City shall deduct, once each regular pay period, the amount
of Western Council dues, fees and insurance premiums as may be specified by
Western Council under the authority of a payroll deduction authorization
signed-and dated by the employee. Said deduction, together with a written
statement of names and amounts deducted, shall be forwarded promptly to
the Western Council office.
It is agreed that any change in the above procedure initiated by Western
Council may result in a reasonable charge for costs incurred by the City.
B. Bulletin Board Space - A reasonable amount of space shall be provided to
Western Council on relevant City bulletin boards for legitimate communica-
tions with members.
C. Meeting Space.- Western Council may be granted use of City facilities by
the appropriate authority for meetings composed of City employees, provided
such meetings are held outside regularly scheduled working hours for the
group which is meeting, and provided space can be made available without
interfering with City needs.
Western Council agrees to provide proper advance notice of such meetings and
pay -any contingent costs of security, supervision, damage and cleanup.
D. Work Location Access - Authorized representatives of Western Council shall
be allowed reasonable access to employees of the unit at their work locations
during working hours for the purpose of consulting with employees in the
unit regarding the employer-employee relationship, provided that (1) the work of
the employee and the service of the public are not unduly impaired, and
(2) the authorized representative shall have given advance notice to the
department head or his designated representative when contacting departmental
employees during the duty period of the employees. The department head
shall determine the appropriate time for such access.
E. Representation - Western Council may designate two (2) employees plus
alternates who serve as official representatives. Such persons shall be
released from work, without loss of compensation, when formally meeting and
conferring with management representatives on matters within the scope of
representation.
F. Information - City shall provide to Western Council, upon request, such
literature and documents as may be necessary (i.e., City Budget, Workers'
Compensation benefits). A reasonable duplication charge may be made for
items not normally available for wide distribution.
II. Wages
A. Effective the first payroll period of Fiscal 1978-79 (July 14, 1978),
represented classifications shall be granted salary increases as follows:
Associate Civil Engineer 5.5%
Assistant Civil Engineer 5.0%
Junior Civil Engineer 5.0%
Plan Checker II 5.0%

Employees in this unit will have the option of placing a total of 7%
of base salary into a "deferred compensation" plan which is based upon
the employee contribution to the Public Employees' Retirement System.
Employees in this unit are advised that there may be a question as to
the practicability of such a plan and they could, as a result of an ad-
verse I.R.S. or judicial ruling, be ineligible for such a plan.
B. Merit increases will be granted at the beginning of the payroll period
closest to the employee's actual qualifying date.
C. Represented classes shall be eligible to participate in the City's approved
Deferred Compensation Plan.
III. Differentials
A. Bilingual Pay - Those employees who, upon recommendation of their
Department Head, approval of the Personnel Department and City Manager,
and successful completion of a Bilingual Performance Evaluation, are
required to use their bilingual skills in the performance of their
duties, will receive $25 a month in addition to their regular pay.
B. Out of Class Assignment - Members in this unit who are assigned, with
the approval of the appointing authority, the normal duties of higher
level positions for more than 30 days will be compensated at a rate
5% above their current salary, commencing the thirty-first day.
C. Extraordinary Service - Effective January 1, 1979, the City will offer a
differential of up to seven and one-half (7 1/2%) percent to those E Step
employees who qualify. Criteria for eligibility will be developed jointly
with employee association representatives. Recommendation for the dif-
ferential will be at the discretion of the Department Head, subject to the
approval of the City Manager. The duties/productivity of relevant individuals
will be reviewed at least every three (3) months and a determination made
regarding continuance of the differential.
IV. Health Insurance
Effective July 14, 1978, the City will pay the premium for the designated
Travelers Comprehensive Medical Expense Benefit plan for each employee. At
the employee's option, the City will contribute an equal dollar amount to an
approved Kaiser Plan, with the employee paying any excess.
V. Lona Term Disabili
Effective July 14, 1978, the City will contribute up to nine-tenths percent
(.9%) of employee base salary for an approved Standard long-term disability
plan.
VI. Sick Lea~de Reimbursement
Employees with five (5) or more years of service shall be allowed to receive
twenty-five percent (25%) payment for up to 120 days of unused sick leave
upon honorable separation from the City. The fifty percent (50%) survivors
benefit is also to be made available to the represented unit.

VII. Workweek
The basic workweek for City employees is forty (40) hours. However, members
of the represented unit may be permitted to work a flexible schedule provided
not more than eighty (80) hours are designated in a fourteen (14) day pay
period (0001 Friday to 2400 Thursday).
Specific arrangements shall be made with, and approved by, the Director of
Public Works. Core hours, during which an employee must be available shall
be between 9:00 a.m. and 4:00 p.m., on a scheduled day of work. Arrival and
departure times shall be established in concert with an employee's immediate
supervisor and may be changed upon reasonable notice.
VIII. Promotion Within Job Famil
The Junior Civil Engineer classification will be considered as career advance-
ment to the Assistant Civil Engineer level. Employees will not be required
to undergo a promotional exam but will qualify for certification upon (1) ful-
fillment of minimum qualifications and (2) forwarding of a positive recommenda-
tion by the relevant appointing authority.
IX. Labor-Management Cooperation
During the term of this agreement the City agrees to explore on-going relationships
with this and other bargaining units beyond the traditional negotiation process.
The objective is to jointly develop and implement programs designed to improve
City operations and enhance employee satisfaction.
X. Continuation of Existing Benefits
It is further understood and agreed that any other benefits and working conditions,
as specified in this agreement or any other published City document, and the
terms and conditions thereof presently in effect shall remain unchanged (except
for amendments to the Civil Service Rules which liberalize employee benefits)
unless and until said terms and conditions shall be modified as a result of
meeting and conferring in good faith.
XI. Savings Clause
If any provision of this agreement, or the application of such provision, should
be rendered or declared invalid by any court action or by reason of any existing
or subsequently enacted legislation, the remaining parts or portions of this
agreement shall remain in full force and effect.
DURATION
Pursuant to the adoption by the City Council of implementing ordinances or resolu-
tions, this Memorandum shall become effective July 14, 1978 and shall remain in
effect for a period of approximately one (1) year, terminating July 1, 1979.
