HomeMy WebLinkAboutReso 1978-9372RESOLUTION NO. 9372 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ORDERING THE EL RANCHO DEL REY/RIDGEBACK ROAD REORGANIZATION INVOLVING ANNEXATION TO THE CITY OF CHULA VISTA AND DETACHMENT FROM THE SAN DIEGO COUNTY FLOOD CONTROL DISTRICT - ZONE 3 The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, pursuant to the District Reorganization Act of 1965, commencing with Section 5600 of the Government Code, a peti- tion has been received by the City Clerk of the City of Chula Vista proposing a reorganization consisting of the following changes of organizations: 1. Annexation of territory to the City of Chula Vista as shown on Exhibit A and described in Exhibit B. 2. Detachment of the territory described in Exhibit B from the San Diego County Flood Control District, Zone 3. WHEREAS, the petition of landowners constituting 100 con- sent to said reorganization has been received and no public hearing has been conducted in accordance with the provisions of Section 56430 et seq. of the Government Code, and WHEREAS, the City Council approved the E1 Rancho del Rey/Ridgeback Road Reorganization to file the proposed reorganization with LAFCO, dated October 2, 1978, approved said reorganiza ment of the territory from the San Diego County District, Zone 3, and boundaries of the and authorized staff which by resolution tion and the detach- Flood Control WHEREAS, the City Council is now authorized to conduct said annexation proceeding without notice and hearing and without an election. NOW, THEREFORE, BE IT RESOLVED that the City Council hereby finds and determines and orders as provided in Government Code Sec- tion 56430 et seq. as follows: 1. The territory proposed for reorganization (hereinafter referred to as the Territory) is as described in Exhibit B attached hereto. 2. The description of the boundaries of the Territory conforms to lines of assessment and ownership. 3. All owners of land have consented in writing to the proposed reorganization. 4. The territory includes 1.2 acres and is uninhabited. 5. The Council hereby certifies that it has reviewed and considered the information contained in Negative Declaration, IS-79-14, which was prepared in accor- dance with the California Environmental Quality Act of 1970, as amended. -1- 6. The Council does hereby approve the proposed reorgani- zation consisting of annexation of territory described in Exhibit B to the City of Chula Vista and detachment of territory described in Exhibit B from the San Diego County Flood Control District, Zone 3. 7. Pursuant to Government Code Section 56271.1, the City of Chula Vista has initiated the reorganization pro- ceedings in compliance with Government Code Section 56340 et seq, and the resolution of LAFCO, and does hereby order said reorganization without notice and hearing and without an election. 8. The City Clerk of the City of Chula Vista be, and she is hereby authorized and directed to transmit a cer- tified copy of this resolution in accordance with Section 56450 et seq. of the Government Code.
