HomeMy WebLinkAboutReso 1988-13856 RESOLUTION NO. 13856 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ADOPTING NEGATIVE DECLARATION IS-89-13 AND AUTHORIZING THE ISSUANCE OF COASTAL DEVELOPMENT PERMIT NO. 041A TO SDG&E FOR INSTALLATION OF WASTEWATER TANKS SUBJECT TO THE CONDITIONS OF APPROVAL IN ATTACHMENT A The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, in accordance with the California Environmental Quality Act, environmental review has been completed on the proposed project and IS-89-13 has been issued; and, WHEREAS, the Chula Vista Bayfront Local Coastal Program (LCP) was certified by the California Coastal Commission; and, WHEREAS, said LCP includes coastal development permitting procedures determined by the Coastal Commission to be legally adequate for issuance of Coastal Development Permits; and, WHEREAS, the City of Chula Vista has assumed permit authority over the ~hula Vista Coastal Zone; and, WHEREAS, a public hearing was held on October 25, 1988, in accordance with said permitting procedures; and, WHEREAS, the City Council of the City of Chula Vista, as approving authority, has reviewed the proposal for installation of wastewater tanks on the SDG&E South Bay Power Plant. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista finds, based on the followin9 findings, in accordance with Section 13311 of the California Administrative Code, that installation of the wastewater tanks is consistent with the policies of the Chula Vista Bayfront LCP. 1. The land use and zoning designations for the SDG&E property are Industrial General. The use of a portion of the property for wastewater storage tanks is consistent with the provision in Section 19.82.35 for allowing "other accessory uses and buildings customarily appurtenant to a permitted (industrial) use." 2. Condition of Approval #1 prohibits grading for site preparation between November 1 and April 1 consistent with Section 19.87.08, Grading and Drainage, of the Bayfront Specific Plan. 3. The project site is owned by a public utility company which has need for restricted access, therefore, the opportunity for public access to the Bay from this site for recreational use is restricted, but not inconsistent with the public access policies of the certified LCP. 4. The proposed wastewater tank heights of 18' - 30' fall within the four- story maximum (44 feet) specified for the site on the Building Height Controls map on page 23 of the Specific Plan. 5. Statewide and regional interpretive guidelines have been reviewed, and the proposed project has been found to be in conformance with the public access and public recreational policies of Chapter 3 of the Public Resources Code. BE IT FURTHER RESOLVED that the City Council of the City of Chula Vista hereby issues Coastal Development Permit #041A for the installation of waste- water tanks on the SDG&E South Bay Power Plant site subject to the Conditions of Approval in Attachment A. Grading for site preparation is prohibited between November 1 and April 1. If the portion of the site preparation which requires grading is partially done, but not expected to be completed by November 1, the site shall be planted for temporary (until April 1) erosion control or a silt fence shall be installed. Such planting shall be accomplished under the supervision of a licensed landscape architect and shall consist of seeding, mulching, fertilization and irrigation adequate to provide 90% coverage within 90 days. Planting shall be repeated if the required levels of coverage are not estabished. Whether the erosion control method utilized is planting or a silt fence, all grading activities shall be suspended on November i until April 1. 2. The proposed color for the wastewater tanks shall be approved by Planning Department Design Review staff prior to issuance of building permits. The proposed color shall be consistent with an overall color theme for the South Bay Power Plant.
