The resolution has been appropriately amended to reflect the decision of the City Council both as to the reasons for the selection of that location, which essentially was the attempt to minimize the interference with the use of the property by the owner, and to provide the most accessible area for the location of the necessary facility as well as the revision of the description of the easement location. Resolution - Consenting to the acquisition of an appurtenant easement in property at Villa San Miguel by means of eminent domain SUBMITTED BY: City Attorney ITEM EXPLANATION (4/5TH'S VOTE REQUIRED YES X NO ) ., L & M Professional Consultants, Inc. have requested that the City consent to the acquisition of an easement near the boundary line of its neigh- boring property which belongs to Frank Ferreira. The easement would be for a sanitary sewer and storm drain to serve the Villa .San Miguel Subdivision. City engineers have explored various 4 alternatives to provide these services including different locations for the easement and the possibility of avoiding the use of condemnation altogether by pumping the sewage out to Hilltop. The proposed easement is considered the least intrusive on neighboring property. The pump station alternative is unsatisfactory due to the fact that it involves continuous use of energy and continuous maintenance in addition to great initial expense. In energy conscious times, the pump station method becomes a less viable alternative. L & M Professional Consultants, Inc. have made an engineering change in the design of the sewer and drainage easement which will place much of the easement in the required setback area of Mr. Ferreira's property and thereby constitute a less damaging intrusion. The Code of Civil Procedure requires certain findings as to the necessity, location and hardship involved in consenting to an eminent domain action and suggested findings are contained in the resolution. As testified at this meeting, the City Engineer stated that he had just received a proposed plan of development from Mr. Frank Ferreira for the adjacent area and did not have time to analyze it and make recommendations to Council. The Council, therefore, continued action on this matter until the meeting of August 28, 1979 to allow staff time for review of Mr. Ferreira's proposal. . ~/ ~~~ Jennie M. Council action on these matters was deferred pending receipt of a report from staff, to be made to the Council on August 28th. At the hearing on August 14th several persons spoke, for a total of approximately 30 minutes. I write to request that if at all possible you avail yourself of the tapes of last night's meeting, so that you may participate in the voting on August 28th. The motion is one for Council approval of the right of L & M Professional Consultants, Inc. to condemn a necessary drainage and sewage easement to service its project. Under the Code of Civil Procedure a four-fifths vote of the Council is necessary to approve this matter, and thus it becomes important that all Councilpersons participate, if at all possible. This letter is written to request the right to address the City Council in opposition to this proposed condemnation resolution. Milgen Investment Co., through Mr. Frank Ferreira and his representatives, would like to be given the opportunity to explain why this resolution should not be adopted. On behalf of Milgen Investment Co., we would also like to respectfully request that the matter of said condemna- tion resolution be continued and postponed for two weeks (until August 7, 1979) due to the hospitalization of Mr. Ferreira for extensive medical examination procedures relating to his bladder and kidneys. He is now scheduled to be admitted for these tests at Mercy Hospital on Monday, July 23, 1979. I have spoken with Mr. Richard A.
