At the City Council meeting of August 28, 1979, the Council, having
reviewed the testimony taken at the hearing of August 14, 1979 and
receiving the recommendation of the City staff, accepted that recom-
mendation and authorized the L & M Developers to institute proceedings
in eminent domain to acquire a 10 foot easement located in the driveway
proposed by the owner of the burdened property as a part of a future
development of the property.
The resolution has been appropriately amended to reflect the decision
of the City Council both as to the reasons for the selection of that
location, which essentially was the attempt to minimize the interference
with the use of the property by the owner, and to provide the most
accessible area for the location of the necessary facility as well as
the revision of the description of the easement location.

ITEM EXPLANATION (4/5TH'S VOTE REQUIRED YES X NO )
., L & M Professional Consultants, Inc. have requested that the City consent
to the acquisition of an easement near the boundary line of its neigh-
boring property which belongs to Frank Ferreira.
The easement would be for a sanitary sewer and storm drain to serve the
Villa .San Miguel Subdivision. City engineers have explored various
4 alternatives to provide these services including different locations for
the easement and the possibility of avoiding the use of condemnation
altogether by pumping the sewage out to Hilltop. The proposed easement
is considered the least intrusive on neighboring property. The pump
station alternative is unsatisfactory due to the fact that it involves
continuous use of energy and continuous maintenance in addition to great
initial expense. In energy conscious times, the pump station method
becomes a less viable alternative.
L & M Professional Consultants, Inc. have made an engineering change in
the design of the sewer and drainage easement which will place much of
the easement in the required setback area of Mr. Ferreira's property
and thereby constitute a less damaging intrusion.
The Code of Civil Procedure requires certain findings as to the necessity,
location and hardship involved in consenting to an eminent domain action
and suggested findings are contained in the resolution.

At the meeting of August 14, 1979, the City Council held
the public hearing to consider the condemnation action
in connection with Villa San Miguel drainage and sewer
easement.
As testified at this meeting, the City Engineer stated
that he had just received a proposed plan of development
from Mr. Frank Ferreira for the adjacent area and did not
have time to analyze it and make recommendations to Council.
The Council, therefore, continued action on this matter
until the meeting of August 28, 1979 to allow staff time
for review of Mr. Ferreira's proposal.

Dear Mr. Councilman:
We represent L & M Professional Consultants, Inc.,
the moving parties on Items 5 and 5a on the Council's
agenda for August 14, 1979. Council action on these matters
was deferred pending receipt of a report from staff, to be
made to the Council on August 28th. At the hearing on
August 14th several persons spoke, for a total of approximately
30 minutes.
I write to request that if at all possible you avail
yourself of the tapes of last night's meeting, so that you
may participate in the voting on August 28th. The motion
is one for Council approval of the right of L & M Professional
Consultants, Inc. to condemn a necessary drainage and sewage
easement to service its project. Under the Code of Civil
Procedure a four-fifths vote of the Council is necessary to
approve this matter, and thus it becomes important that all
Councilpersons participate, if at all possible. We would very
much appreciate your participation in this matter if at all
possible.

The Council continued this matter for two weeks. It
will be rescheduled for the meeting of August 7, 1979
at 7:00 p.m. in the Council Chamber, Public Services
Building, 276 Fourth .Avenue.

Dear Ms. Fulasz~
This law firm presently represents Milgen Investment Co.
for purposes of lodging objections to the proposed condemna-
tion of_ easement rights over property owned in part by Milgen
Investment Co. This letter is written to request the right
to address the City Council in opposition to this proposed
condemnation resolution. Milgen Investment Co., through Mr.
Frank Ferreira and his representatives, would like to be given
the opportunity to explain why this resolution should not be
adopted. On behalf of Milgen Investment Co., we would also
like to respectfully request that the matter of said condemna-
tion resolution be continued and postponed for two weeks (until
August 7, 1979) due to the hospitalization of Mr. Ferreira for
extensive medical examination procedures relating to his bladder
and kidneys. He is now scheduled to be admitted for these
tests at Mercy Hospital on Monday, July 23, 1979. I have spoken
with Mr. Richard A. Paul, who is one attorney f_or the applicant,
L&M Professional Consultants, Inc., about this request for con-
tinuance; and he has agreed to such a two-week continuance of
the matter to permit Mr. Ferreira to recover and personally
attend the hearing on the proposed condemnation.

Dear Ms. Fulasz:
This law firm represents Mr. Frank E. Ferreira. Mr.
Ferreira has been informed that, on July 24, 1979 at 7:00 p.m.,
the City Council of the City of Chula Vista will consider a
proposed condemnation resolution directed toward the proposed
condemnation of sewer and drainage easement rights over pro-
perty which is owned in part by Mr. Ferreira. This letter is
to request the right to address the City Council in opposition
to this proposed condemnation resolution. Mr. Ferreira and
his representatives would like to be given the opportunity to
explain why this resolution should not be adopted.
If possible, I would appreciate receiving a copy of any
proposed resolution which has been prepared in connection with
this matter. I would also like a copy of any proposed resolu-
tion which has been or will be prepared in connection with a
proposed amendment to the Villa San Miguel tentative map, with
respect to relocation of proposed drainage.

Pursuant to our conversations with Tom Harron of the City
Attorney's office, Jim Peterson of the Planning Department, and
Jon Lippitt of the Department of Engineering, this letter con-
stitutes the request of L & Id Professional Consultants, Inc. to
include on the docket for the Council meeting scheduled July 24,
1979, the following two items: (i) approval of an engineering
change in the design of the sewer and drainage easement, which
constitutes a condition to the above-referenced map previously
approved by the Council, and (ii) adoption of a Resolution of
Necessity concerning the exercise of eminent domain in connection
with said easement.
We will be in contact with the City Attorney's office in
connection with the preparation and mailing of notices. Please
confirm to the undersigned in writing that the matters discussed
above will be placed on the agenda for July 24, 1979.
