On August 28, 1979, Council held a public hearing on a
proposed deferral of undergrounding existing overhead
utility services at 428 "F" Street.
During the hearing it was made clear that the deferral could
be effective for approximately four months because of
conversion work that is required in connection with an
existing undergrounding district. It was indicated that
this service would have to be converted by approximately
December 17, 1979, in order to meet the sched ule of the
District. Council directed staff to return with a
resolution approving the deferral ending concurrent with the
date that the district requires service conversion.

Undergrounding Overhead Utility Services at 428 "F"

BACKGROUND:
Anthony Schools is presently remodeling the building located
at 4?_8 "F" Street. The building is currently being served
by overhead utility lines. According to Section 15.32.070
of the City Code, any improvements on a lot exceeding a
valuation of $20,000.00 constitute a requirement for the
owner to convert the overhead services to underground.
On July 12, 1979, Anthony Schools applied to defer the
underg rounding requi rements . The reasons 1 fisted on the
application were that undergrounding of utilities:
a. would not improve appearance, since utility poles would
still exist.
b. would prevent timely operation of business.
c. would be premature because of existing conditions of
surrounding property.

FINDINGS:
The subject property is within an existing Undergrounding
District. This district is scheduled for conversion this
year. The estimated date that structures must be ready to
receive underground service is December 18, 1978.
In effect this becomes a four month deferral. If the
applicant doesn't convert this overhead service to
underground service by December 18, the City Engineer gives
him a 30 day notice after which time his meter is
disconnected. The loss_of electrical service is in effect
our collateral.
According to Section 15.32.070, the Council may defer the
requirements if a) extraordinary conditions exist that
enforcement would result in unnecessary hardship to the
owner and b) such a deferral will not be detricnenta.l to the
health, safety or general welfare of the neighbor~iood.
I do rot necessarily concur with the applicant's reasons or
justification for the deferral.. However, since a district
has been established already, I believe it would be more
cost effective to do his underground conversion at the same
time the district is under construction. Because of the
already established district and the fact that it would be
more cost effective to do the undergrounding concurrent with
the established district, I believe 1) extraordinary
conditions do exist and that Code enforcement would cause
unnecessary hardship to the owner and, 2) since the ser~~ice
will be undergrounded in four months anyway,, such a~deferral
will not be detrimental to the health, safety or general
welfare of the neighborhood. Therefore, I recommend that
staff be directed to return with a resolution granting a
deferral to December 18, 1979.
Anthony Schools is aware that they are within the
Undergrounding District and are willing to convert the
services underground as required.
