Prior to the approval of said map, it is necessary to enter into an agreement securing the payment of required park land and development fees in the amount of $8,000. In accordance with the ordinance, resi- dential construction taxes in the amount of $9,000 must be paid prior to the issuance of certificates of occupancy. Park land fees would normally be paid prior to the issuance of building permits or in the case of condominiums, at the time of approval of the map. The security agreement being executed by the developer provides that the fees must be paid prior to the close of the first escrow in the sale of any of the units. The appropriate agreement has been prepared and executed by the developer's partnership. The developer has requested credit be given for 2,126 square feet of property to be dedicated to the City which would provide access from Tobias Drive to the city park being developed on the San Diego Gas & Electric easement (see attached exhibit). This request ha s. been reviewed by the Director of Parks and Recreation, who has recommended that credit be allowed in the amount of $0.50 per square foot or a total of $1,063 for said access. It should be noted that said access was previously scheduled to be granted to the city as an easement rather than dedicated in fee ownership. Agenda Itegn No. 7 August 21, 1979 Page two In addition, the developer installed three ornamental vapor lamps on the adjacent park property to serve his adjacent condominium project as well as the city park. He is requested that he be given credit in the amount of $500 each or a total of $1,500 for the three lamps. The total amount of credit being requested equals $2,563 which the applicant is requested be deducted from his balance of park and residential construction tax fees of $17,000.
