HomeMy WebLinkAboutAgenda Statement 1979/08/28 Item 10CITY OF CHULA VISTA COUNCIL AGENDA STATEMEiVT Item No. 10 For meeting of 8/28/79 Re solution Accepting Petitions for Street Improvements i n the 000 Block of Las Flores Drive From "D" Street Northerly to ITEM T ITLE the City Boundary and Directing the City Engineer to Proceed with the Formation of an Improvement Act Assessment District and Prepare the Necessar Plans, Specifications and Cost Estimates SUBMITTED BY City Engineer ITEM EXPLANATION (4/5TH'S VOTE REQUIRED YES NO x ) As you may recall, on May 1, 1979, a report was accepted by the City Council regarding the formation of an Improvement Act Assessment District for "D" Street and Las Flores Drive. At that time, because of two main factors -- 1) lack of interest in the formation of an Improvement Act District and 2) the existence of a number of deferrals for public improvements in the area -- staff recommended 1. That no Assessment District be formed for the construction of public improvements for Las Flores Drive and "D" Street; 2. Engineering include in its work program for this area the establishment of a preliminary grad e. This would provide a continuity in design for those properties wf~ich now have deferrals ("D" Street and Las Flores Drive south of "D" Street). 3. City consider for inclusion in its 1979-80 Capital Improvem ent Program the construction of a storm drain system and 24' wide ribbon pavement (where necessary to provide access to properties with deferrals) in "D" Street and Las Flores Drive south of "D" Street. If monies are approved, City to establish reimbursement district for the cost of City participation. Therefore, only minor City expenses are expected unless there is a 50% protest at the protest hearing. If the district is stopped at the protest hearing, City will need to absorb cost of preparing plans and specifications. However, this cost may be recouped when that area eventually does develop. STAFF RECOMMENDATION Accept the petitions and authorize the City Engineer to proceed with the formation of the Improvement District and to prepare the necessary pans and cost estimates. CI ~~~ V ^?~ Form A-113 (Rev. 5/77) Agenda Item No. 10 For Meeting of 8/28/79 Supplemental Page Two The City did appropriate the sum of $109,000 ($99,000 for construction and X10,000 for engineering) in the 1979-80 budget for item 3 above. Since approval of that report, there has been a renevrLd interest on the part of property owners north of "D" Street for the formation of an Assessment District. An Improvement District Petition and Waiver was filed in the Office of the City Clerk on August 6, 1979, requesting that an Improvement Act Assessment District be formed far the construction of curb, gutter, sidewalk, paving, storm drain, water main, underground utilities, street lights, sever lines, grading, right-of-way acquisition and lot grading in the 000 block of Las Flores Drive. The petition has been signed by owners representing 68.22,0 of the area of the proposed district as shown on the attached plat. This petition included lot grading, however, this cannot be included in an Assessment District. Only that grading necessary for° construction of the public facilities can be done. Some lot grading may be accomplished that is incidental to the construction of the road. The petition included construction of sewer facilities. The sewer construction is currently budgeted in the Capital Improvement Program. The sewer v~ould allow el imiriation of the Rosebank Pump Station thereby decreasing maintenance and energy costs. We considered the alternative of not constructing the sewer now but constructing it as part of the proposed Assessment District. Advantages of that proposal are: 1. the construction of the entire project at one time; 2. the Assessment District vrould fund the project rather than the sewer income fund, thus eliminating the necessity of the City establishing a Reimbursement District for the sewer ONLY project. The disadvantages of that alternative are: 1. The project is budgeted now and tV~e el imination of the pump station now would reduce maintenance and operation costs. 2. The sevrer project will be ready for construction soon. If vie wait for the Assessment District process (1-1 1/2 years) , inflation would make the sever project more expensive. 3. Even though we have a petition for the Assessment District, we are not assured that in fact the district will be a reality. Whether or not the area is developed the sewer project is still justified. We believe it more advantageous to build the sev,~r soon, if we can readily obtain sewer easements. We will then establish a Reimbursement District for the City to recoup its costs for construction of the sever. 1~~ Agenda Item No. 10 For Meeting of 8/28/79 Supplemental Page Three Based on this neH~ support for an Assessment District, I recommend that we proceed with the formation of an Improvem ent District and prepare the necessary plans and cost estimate.
