The scope of the work included installation of concrete curbs, gutters, sidewalks, driveways, street lights, asphalt pavement, sewer facilities, and other related items of work. Bids were received from two contractors as follows: BIDDER AMOUNT Daley Corporation $84,112.00 San Diego T. B. Penick & Sons, Inc. $87,287.8.5 San Diego The low bids submitted by Daley Corporation is above the Engineer's estimate by $13,711.00. City will assume maintenance of the improvements upon completion of project. STAFF RECOMMENDATION 1. City Council accept bids and award contract to Daley Corporation in the amount of $84,112.00. The low bid exceeded the engineer's estimate due to the unexpected higher cost for roadway excavation. Recent costs for roadway excavation have escalated rapidly. Contact was made with various contractors and a review of recent bids in the Daily Construction Service indicates that the unit price paid for this type work has almost doubled. The expense for this type of work has dramatically increased due to the recent increases in the cost of fuel which has at least doubled in recent months. The property owners have been notified in writing by staff and also officially by the City Clerk as required in the "Streets and Highway Code" that the apparent low bid exceeded the Engineer's estimate by more than 15~. In our letter to the property owners we indicated that staff would be recommending award of the contract at tonight's meeting. Slides showing the area to be improved are available for Council viewing. FINANCIAL STATEMENT: This is a 1911 Act project and it will not be necessary for the Council to authorize the expenditure of any money at tonight's meeting. Funds in the amount of $149,472.50 are available in Account No. 500-5000-RC04 to cover incidental expenses for various assessment act proceedings. The cost of relocating water services and meters is estimated at $1,380 and will be paid for from this account. At the end of construction another public hearing will be held on the spread of assessments. At that time any expenses that the City has incurred for water service relocation, engineering, title reports, inspection, sale of bonds, purchase of force main will be included in the assessment and will be reimbursed and paid for by the property owners. ti~ ~~ July 19, 1979 File: AY043 T0: Jennie Fulasz, City Clerk FROM: Ken Goldkamp, Senior Civil Enginee SUBJECT: Walnut Avenue 1911 Act Assessment District No. 79-1 On August 7, 1979, we will be recommending to the City Council that the subject project be awarded to the lowest responsible bidder, Daley Corporation, San :Diego. Should the City Coucil accept the recommendation to award the project, Sections 5062, 5063 and 5248 of the Streets and Highways Code will require that you do the following: 1. Publish (twice) the notice of award of contract. Attached for your use is a copy of the notice format required by the code. Affidavits of publications must be obtained from the publisher of the newspaper in which the publication was made. 2. Record the notice of the award of contract in the Office of the County Recorder. The recorder fee must be paid by the City from funds in Account No. 600-6000-RC-04. Should City Council award the project, we recommend that you satisfy the above listed items on the following date. a. First publication - August 12, 1979 b. Second publication - August 16, 1979 c. FULASZ, CITY CLERK ~.~ City o~ CInu.Qa ~U~sta CALIFORNIA NOTICE OF AWARD OF CONTRACT FOR 1911 ACT ASSESSMENT DISTRICT 79-1 WALNUT AVENUE STREET IMPROVEMENT DISTRICT Pursuant to the requirements of Section 5248 of the Streets and Highways Code, notice is hereby given that a contract has been awarded by the City Council of the City of Chula Vista, California, to Daley Corporation, San Diego, California, for the installation of concrete curbs, gutters, sidewalks, driveways, street lights, asphalt pavement, sewer facilities and other related items of work in the 1911 Act Assessment District 79-1 Walnut Avenue Street Improvement District. The project relates to the following described real property in the 1100 Block of Walnut Avenue: From 192 feet northerly of Palomar Street to 735.5 feet northerly This shall constitute notice to all persons that all property within the boundaries of the proposed assessment district shall be assessed at the time of the confirmation of the assessment under Chapter 16 (commencing at Sec- tion 5360) of Part 3 of this division to pay the costs of the improvement in proportion to the benefits which said property receives from the improvement, notwithstanding the acquisition of any such property by the State or any of its agencies, or by any county, city, municipality or other public or municipal corporation. Reference is made to the minutes of the action taken by the City Council of the City of Chula Vista on August 7, 1979, Resolution No. 9720 on file in my office for full particulars.
