N0~) A. BACKGROUND 1. On June 26, 1979 Council declared its intent not to consider applications for the conversion of apartments to condominiums. 2. On July 10 Council agreed to consider the Bonnie Brae application as it is related to a previously approved application and it was filed prior to the Council's June 26 action. 3. The project is exempt from environmental review as a class 1(k) exemption. 6. DISCUSSION 1. Existing site characteristics. The project site is a 0.85 acre parcel located on the north side of Bonita Road adjacent to the Chula Vista P1unicipal Golf Course and within the 100 year flood level of the Sweetwater River flood plain. The site has been raised one foot above flood level and was developed in 1973 with a two story 20 unit apartment building. Thirty- two parking spaces, 20 of which are located in carports, are located in front, between the units and the street, and comply with the present requirements of the city code. A swimming pool and Jacuzzi are located in the center of the apartments. 2. Condominium regairements. a. Private open space. FINANCIAL IMPACT STAFF RECOMMENDATION Concur with Planning Commission, subject to the condition that the storage spaces be architecturally compatible with the existing buildings and constructed subject to approval of the Zoning Administrator prior to the issuance of a Certificate of Occupancy. BOARD/COMMISSION RECOMMENDATION On June 13 the Planning Commission voted 5-1 (with one member absent) to recommend approval of the tentative subdivision map in accordance with Resolution PCS-79-19. Utility services. Each unit has individual gas and electric service meter and there is one house meter for the common areas and recreational facilities. The water is provided by one central meter which will be the responsibility of the homeowners' association as will the house meter. c. Storage space. The proposed condominium storage amendment establishes a sliding scale based on the number of bedrooms per unit and includes the requirement that at least 40% of the required storage space be located adjacent to the unit. The applicant has revised his original storage plan to meet the proposed amendment. Each unit has adjacent storage which either meets or exceeds the proposed minimum requirements. The applicant has provided a minimum of 244 cu. ft. to a maximum of 336 cu. ft. per unit. The portion of the storage space which is not adjacent to the unit is located in a divided storage room or in the carports. The developer has indicated that a "lender set-aside" letter will be provided which will ensure that the storage areas will be constructed and secured with locks as required by the City. 3. Requirements. In addition to any conditions of approval, the developer will be required to fulfill the following ordinance requirements. a, Pay the Residential Construction Tax for condominiums of $375 per unit plus $25 for each bedroom in excess of one (total $8,500) prior to recordation of the final map. b. Pay the Park Acquisition and:Deve~opment fee of $200 per unit ($4,000 total) prior to recordation of the final map. c. Each of the tenants of the proposed condominium project shall be given 120 days written notice of the intention to convert prior to termination of tenancy. The developer shall provide rental assistance information to all displaced tenants. Evidence of delivery of the written notice shall be submitted to the City Engineer prior to approval of the final map. d. Each of the tenants of the proposed condomin project shall be given written notice of exclusive right to contract for the purchase of their respective units. Evidence of the delivery of said written notice shall be submitted to the City Engineer prior to approval of the final map. e. The subdivider shall file with the City a Declaration of Covenants, Conditions and Restrictions naming the City of Chula Vista as a party to said Declaration and authorizing the City to enforce terms and conditions of the Declaration in the same manner as any owner within the subdivision. Said Declaration shall be subject to approval of the City Council concurrent with approval of the final map. ~~~2
