A. BACKGROUND
1. On June 19 Council denied, by a vote of 4-1, the tentative map which would have
authorized the conversion of a recently completed 12 unit apartment complex on the south
side of Arizona Street, east of Broadway, to condominiums. After that action, there was
an indication by the applicant that he may be willing to accept the staff recommendation
for approval which would require modification of two balconies in order to provide adjacent
storage. It was expected that the applicant and staff would discuss this during a break in
the meeting. Council did not take a break and the applicant left the chambers.
2. The Assistant City Attorney has expressed some concern that the Council had no
findings in support of its action denying the map.
B. DISCUSSION
1. As indicated in the June 19 report to Council, staff had recommended approval of the
map subject to two conditions, one pertaining to storage and the other pertaining to the
dedication of a drainage easement across the southerly edge of the site. This continues to
be the staff recommendation and the recommended conditions are repeated under "Staff Recom-
mendation" in this report.
2. The applicant has expressed a willingness to meet the recommended conditions of
approval which would bring the proposal into conformance with the existing ordinance and
the proposed modification thereto. The Assistant City Attorney has indicated that under
those circumstances he sees no basis for denial of the map. Of course, any denial of the
map must be accompanied by findings of fact which justify the denial. Accordingly, an
action by Council to sustain its June 19, 1979 denial should be accompanied by a statement
of findings.

FINANCIAL IMPACT
STAFF RECOMMENDATION Adopt resolution approving the tentative map subject to the conditions:
1) A minimum of 80 cu. ft. of private storage space shall be provided adjacent to and at
the same level of each of the interior second floor units presently without adjacent
storage.
2) An easement for drainage purposes along the southerly end of the project site be granted
(or an irrevocable offer of dedication be made) as required by the City Engineer.
BOARD/COMMISSION RECOMMENDATION
On May 23, 1979 the Planning Commission voted 4-2 (with one member absent) to recommend
approval of the tentative map in accordance with Resolution PCS-79-18.

3. No requirements for construction of or contribution toward Telegraph Canyon
channel have been recommended because the cost of the channel will be federally funded
and construction wi11 be administered by the Corps of Engineers. Construction is
presently scheduled to be initiated between October 1980 and October 1981. Construction
of improvements by this developer is believed inappropriate because no detailed plan is
available and because the incorporation of this small portion of the improvements into
the overall project would most likely be more expensive than building the improvements
themselves. Right of way dedication, however, is a condition of approval for the sub-
division.
