ITEM TITLE Report on Bonita-Sunnyside Fire Protection Agreement

Payment for fire protection provided by Bonita-Sunnyside Fire Protection District was
due March 15, 1979, but has not been made. Funds in the amount of $37,890 are included
in the 1978-79 budget and that amount is based on the formula provided in the 10-year
old agreement that expires June 30, 1979, i.e., assessed valuation of the City area
protected by the District X the tax rate necessary to equal the oro rata share of the
total District budget( §ee Exhibit 1).
The immediate problem to be resolved is the amount of money the City must pay for the
protection provided during 1978-79. While the Fire District technically did not levy
a tax rate due to the passage of Proposition 13, staff believes the basic formula pro-
vided in the agreement is still valid and may be used to determine the value of ser-
vice provided. In as much as the assessed valuation of the Bonita contract area in-
creased approximately $1.5 million and the District's budget was $550,726, a theoretical
tax rate of 86~ per $100 of assessed valuation would have been required to meet the
District's total budget. Applying that 86~ per $100 of assessed valuation to the value
of property within the City would result in contract costs of $41,731.83.
Based on the Bonita-Sunnyside contract due to expire on June 30, 1979, staff feels the
payment of $41,731.83 utilizing the existing formula is justified. However, a special
appropriation of $3,900 is required to meet this expense.
The second question that needs to be answered is should the City continue to contract
for this service on July 1, 1979? Staff believes the contract with Bonita-Sunnyside
should not be renewed. Rather, the Chula Vista Fire Department should begin first-in
response on July 1, 1979.

A major impact of this proposal could eventually result in tl~e Insurance Services
Office (ISO) regrading of the Bonita commercial property. Currently, ISO maintains
a criteria of a 3-mile maximum between the responding fire station and the commercial
area. The City of Chula Vista's response distance is slightly over this guideline
(see Exhibits 2 and 3). ISO in Los Angeles has no idea when or if a regrading of
the Bonita commercial area would occur if Council approves the proposal. It is impor-
tant to note there would be no impact on the Bonita residential areas if a regrading
occurs.
As indicated in the attached letter (Exhibit 4), a decision on this matter must be
made in the very near future because with the expiration of the existing contract,
the District will have no legal responsibility to protect the area. If our proposal
is approved, the Chula Vista Fire Department is prepared to respond to Bonita with
(1) 1,000 gpm pumper from Station No. 4, (1) 1,250 gpm telesqurt from Station No. 2,
and (1) 100 foot aerial ladder from Station No. 1.

In re: Contract between the City of Chula Vista
and the Bonita Sunnyside Fire Protection
District
At the direction of the Board of Directors of the Bonita Sunny-
side Fire Protection District this letter is written to the City
of Chula Vista advising that the contract entered into between the
City of Chula Vista and the Bonita Sunnyside Fire Protection Dis-
trict in 1969 will expire on July 1, 1979. After the expiration
of the contract, the Bonita Sunnyside Fire Protection District has
no legal right nor does it have any responsibility to furnish any
fire preventive or safety services to the area heretofore covered
by the contract. Unless there is a new contract entered into, the
Bonita Sunnyside Fire Protection District can not respond to any
request coming from the contract area. As you are aware, there
has been no payment made for the period covering July 1, 1978 to
July 1, 1979 and any new contarct will have to provide for the
money due by reason of the protection for the past year as well as
a method of payment for any subsequent years.
It is the responsibility of the City of Chula Vista to notify the
residents and occupants within the contract area, including Rohr
Park and the Bonita Golf Course, that all requests for service will
have to be made to the proper authorities of the City of Chula Vista.

The Board of Directors regrets that the City of Chula Vista has been
unable to present a fair proposal for the payment of past services
as well as a contract for future services. After the last meeting
with the Mayor, Councilman Scott, the City Manager and the Assistant
City Manager and City Attorney, the Board of Directors believed that
some fair proposal would be forthcoming from the City of Chula Vista.
