ITEM TITLE Resolution 9rO ~~- Opposing SB 462 (Dills) requiring Statewide
regulation of billboards

The Legislative Committee erroneously thought that the Council had previously taken
action on SB 462 (Dills). A hearing is scheduled for Wednesday, July 18, before the
Assembly Committee on Local Government and the Legislative Committee recommends that
the Council adopt the attached resolution which strongly opposes the intrusion into
local government in control of billboards and other signs.
This bill would prohibit cities from requiring the removal of billboards without
payment of compensation. This is another example of the State getting involved
in local land use decision-making. These State onslaughts against local home rule
are not consistent with decisions of the U. S. Supreme Court. In the obiter dicta
of Berman v Parker and the Village of Belle Terre v Borass, the court held that
the cities not only have the power to promote the orderly growth and development
of the territories within their jurisdiction, but have the responsibility to do
such through the exercise of their police powers.
Billboards and signs are clearly a zoning matter and should remain as the respon-
sibility of the local legislative body. This bill should be strongly opposed
and the attached resolution adopted by the City Council.
