RESOLUTION NO. 9724 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA REQUESTING CONSOLIDATION OF ELECTIONS TO PLACE A PROPOSITION ON THE BALLOT FOR THE NOVEMBER ELECTION The City Council of the City of Chula Vista does hereby res lve as follows: WHEREAS, the City of Chula Vista has heretofore adopted Ord nance No./8'7S calling a special election to be held in the Cit of Chula Vista on the first Tuesday, following the first Mon ay in November, 1979, and WHEREAS, pursuant to Division 14, Part 2, Chapter 4 (co encing at Section 23300) of the Elections Code and in par- tic lar Sections 23302 and 23314 thereof, the Board of Supervisors of he County of San Diego has authority to consolidate elections cal ed by a district, city or other political subdivision for the sub fission of any question, proposition or office to be filled, wit a general school district election to be held the same date, and WHEREAS, it is desirable and in the public interest tha the said elections be consolidated. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that pursuant to Division 14, Part 2, Cha ter 4 (commencing at Section 23300) of the Elections Code, the Board of Supervisors of the County of San Diego be, and is her by requested to consolidate the election called by the City of hula Vista to be held on the first Tuesday, following the fir t Monday in November, 1979 with the general school district ele tion to be held the same date. BE IT FURTHER RESOLVED that for the purposes of such con oldation the exact form of the Charter amendment to be voted upo at said election shall be set forth on the ballot as con- tai ed in Exhibit "A", attached hereto and incorporated herein by eference as if set forth in full. BE IT FURTHER RESOLVED that if this consolidation is ord red then pursuant to Section 23306 of the Elections Code, (a) the election shall be held in all respects as if there were only one election; (b) only one form of ballot shall be used; and (c) the Registrar of Voters of San Diego shall canvass the returns of the subject election as part of the canvass of the returns of the gen ral school district election. BE IT FURTHER RESOLVED that if this consolidation is ord red, then pursuant to Section 23305 of the Elections Code, wit in the territory affected by the order of consolidation, the ele tion precincts, polling places, voting booths and polling hou s shall, in every case be the same, and there shall be only one set of election officers in each of the precincts. BE IT FURTHER RESOLVED that the Board of Supervisors of the County of San Diego be, and is hereby requested to authorize and direct the Registrar of Voters of the County of San Diego, to per orm services necessary to conduct the election called by the Cit of Chula Vista, to be held on the first Tuesday, following the first Monday in November, 1979 with the cooperation and assis- tan e of the City Clerk of the City of Chula Vista, such services to nclude the following as appropriate to the subject election: -1- 1. Furnish a tabulation of the number of registered vot rs in each precinct. 2. Establish voting precin~.s, secure locations for pol ing places, secure the services of election officers for each pre inct as required by law, and furnish a list of precincts, pol ing places, and election officers for filing in the office of the City Clerk of the City of Chula Vista. 3. Prepare and furnish to the election officers necessary ele tion supplies for the conduct of the election. 4. Cause to be printed the requisite number of sample bal ots, official ballots, polling place slips, rosters, tally she ts, and other necessary forms, along with Spanish translation, as ectuired. 5. Furnish and address the envelopes necessary to mail sam le ballots to the registered voters of the City of Chula Vista. 6. Insert the sample ballots and other printed matter int envelopes for mailing, and cause the same to be mailed, as req fired by law. 7. Assemble the election material and supplies into bal of bags and make necessary arrangements for their delivery to he various precincts. 8. Issue absent voter ballots as required by law. 9. Receive the returns of the election and supplies. 10. Sort and assemble the election material and supplies in reparation for the canvassing of the returns of the election. 11. Canvass the returns of the election, including the abs nt voter ballots. 12. Furnish a tabulation of the number of votes given in ach precinct. 13. Make all arrangements and take the necessary steps to ay the members of the precinct boards, the polling place ren als, the persons returning the ballot bags, and to pay all oth r costs of the election incurred as the result of services per ormed for the City of Chula Vista. Pay for the election off'cials in the amounts prescribed by the Board of Supervisors of he County of San Diego. BE IT FURTHER RESOLVED that the Board of Supervisors of the County of San Diego be, and is hereby requested to authorize and direct the Auditor and Controller of the County of San Diego to ssist the Registrar of Voters of the County of San Diego in the conduct of the election by the drawing of warrants as appro- pri to for the payment of the members of the precinct boards, the polling place rentals, the persons returning the ballot bags, and the other costs of the election incurred as the result of the services performed for the City of Chula Vista in the conduct of he election. -2- ti~ BE IT FURTHER RESOLVED that the City of Chula Vista reim- bur e the County of San Diego in full for services performed by the Registrar of Voters of the County of San Diego in conducting the sub ect election as aforesaid. BE IT FURTHER RESOLVED that the City of Chula Vista agrees to old harmless the County, its officers, agents and employees from exp nse or liability, including reasonable attorneys fees, as the res It of an election contest arising after conduct of the election. BE IT FURTHER RESOLVED that the City Clerk is hereby aut orized and directed to deliver forthwith four certified copies of his resolution to the Clerk of the Board of Supervisors of the Cou ty of San Diego and one certified copy of this resolution to the Registrar of Voters of the County of San Diego. (c) Compensation. The Mayor shall receive an annual salary of twelve thousand dollars ($12,000.00) per year payable at the~rate of one thousand dollars ($1,000.00) per month and shall receive reimbursement on order of the Council for Council-authorized travel and other expenses when on official duty out of the City, and in addition, shall receive the sum of fifty dollars ($50.00) per month, which amount shall be deemed to be reimburse- ment of other out-of-pocket expenditures. The City Council may also provide, by resolution, for the payment to the Mayor of an allowance of a sum certain per month, as reimbursement for the additional demands and expenses made upon and incurred by the Mayor. The salary provided herein may be annually increased beyond said amount by an ordinance or amendment thereto enacted by the City Council in accordance with the limi- tations set by the Government Code of the State of Cali- fornia for the annual increase of compensation for Councilmembers.
