On June 12, 1979, Council held a public hearing on this
proposed vacation. During the course of that hearing it way
made apparent that owners or lessees of adjacent or
otherwise affected properties were opposed to this vacation.
Council directed staff to meet with the proponent and other
interested parties in an effort to determine whether a
mutually satisfactory .solution to the problems associated
with the vacation could be worked out.
Such a meeting was held on Monday, ~7une 18, 1979. The
issues of concern discussed at that meeting were
essentially:
1, the continuation of access along the Madison Avenue
alig nment after a portion of the existing right-of-way
had been redeveloped as a parking lot and vehicles were
able to back out of right angle parking stalls into the
access way;
2. interference with access due to trucks loading or
unloading at docks, along the west side of an existing
building which is to be modified and incorporated into
the redevelopment plan;

City Council conduct continued public hearing,. accept this report and
adopt resolution vacating the street, upon receipt of approved access
easements and reserving an easement fc~s sewer purposes, and contingent
upon redevelopment of the petitioner's property.
BOARD/COMMISSION RECOMMENDATION
Planning Commission at its meeting of May 9, 1979, by a vote of 4-2
recommended approval of subject vacation with the condition that
petitioner grant a 25-foot easement for ingress and egress to the
owners offthe property abuttin the south ~nus of the subject

3. removal of sidewalks presently used for pedestrian
access to Nurseryland from "H" Street; and
4. continuation of acceptable access to the California
First Bank which fronts on Broadway along an existing
easement from Madison Avenue.
These items were not resolved to the satisfaction of
everyone during the meeting.
This portion of Madison Avenue is the only public street in
the City whose purpose is to provide access into a shopping
center that staff is aware of.
It is the opinion of staff that this vacation is appropriate
so long as access to adjoining interests is preserved
through reservation of access easements to those interests,
and redevelopment of the property owned by the proponent for
this vacation is accom pushed in such a manner as to
accommodate this access. The resolution makes the vacation
of_ the street contingent upon redevelopment of the property.
The vacation would then become effective upon issuance of a
Building Permit for redevelopment and security deposited
with City for work within right-of--way and recordation of
easements to property owners to the south.
The nirector of Planning believes that the redevelopment of
the petitioner's property which would be allowed by this
vacation will benefit the City as well as all the properties
involved. If the street is not vacated a less desirable
redevelopment could occur.
The architect for the proponent has met separately with
staff and is modifying the site plan in such a manner as to
provide an entrance throat about ~0 feet long to the south
of the "H" Street improvements to provide a clear entrance.
He also clarified the loading dock situation and staff sees
no probability that the future use of the remaining dock
will impair use of the access easement.
The existence of an easement held by the California First
Bank along the southerly line of the proponent's property is
not shown on City records, consequently no provision was
made f_or its continuation in our previous report. This
provision is incorporated in our recommendation included in
this report.
