HomeMy WebLinkAboutReso 1979-9706/ " RESOLUTION NO. 9706 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING A TANDEM DESIGNATION AGREEMENT ~n1ITH THE CALIFORNIA HOUSING FINANCE AGENCY RELATIVE TO PARTICIPATION IN THE HOME OWNERSHIP AND HOME IMPROVEMENT PROGRAM AND AUTHORIZING MAYOR TO EXECUTE SAbiE hei The City Council of the City of Chula Vista does y resolve as follows: WHEREAS, the City of Chula Vista has submitted an ap lication to the California Housing Finance Agency for participation in the Home Ownership and Home Improvement Program; and, WHEREAS, said application has been approved by the CH A Board of Directors on July 17, 1979; and, WHEREAS, the City of Chula Vista is desirous to insti- tu e a program of financial assistance to assist persons of low and mo erate-income to obtain decent, safe and sanitary housing; and, WHEREAS, the Feaster School Neighborhood, Vista Square Ne ghborhood and Mueller School Neighborhood have been designated as Co unity Development Block Grant target areas. NOW, THEREFORE BE IT RESOLVED that that certain agree- me t (Tandem Designation Agreement) between the City of Chula Vista an California Housing Finance Agency for services relative to the Ho e Ownership and Home Improvement Program dated this 1st day of ul , 1979 a copy of which is attached hereto and incorpo- ra ed herein, the same as though fully set forth herein be and the sa e is hereby approved. City Clerk CC-6 TANDEM DESIGNATION AGRF.F:MF.NT THIS AGREEMENT, is made this 1st day of July , L9 79 by and between the California Housing Finance Agency ("AGENCY"), a political subdivision of the State of California, and the City of Chula Vista ("LOCALITY"), ~ local public entity. RECITALS A. AGENCY and LOCALITY wish to institute a program of finan- ~ial assistance and provide related services necessary to assist persons of low and moderate income to obtain decent, safe and sani- tary housing in accordance with the provisions of Division 31, ?arts 3 and 5 of Health and Safety Code of the State of California (the "Code"). B. AGENCY has received and reviewed an application submitted by LOCALITY for designation of (an) area(s) within the jurisdication of LOCALITY (described in Exhibit K ) as (a) participating concen- trated rehabilitation area(s) within the meaning of Section 50062 of the Code and as a participating mortgage assistance area within Section 50085 of the Code, and AGENCY has designated the areas in Agency Board of Directors Resolution 79-58 as such pursuant to Section 51302 and 51304 of the Code. NOW, THEREFORE, the parties hereto agree as follows: ARTICLE I Subject to LOCALITY's adoption, implementation and continuance ~f the programs described in Article II hereof, AGENCY agrees to purchase '~ortgage Loans and Home Improvement Loans for those properties and borrowers described in Exhibit A. All such loans shall be made by AGENCY approved qualified mortgage lenders as such Lenders are defined in Section 50094 of the Code. A. Definitions. 1. "Home Improvement Loan" means an advance of money evidenced by a note to finance rehabilitation or general repairs and improvements to eligible residential structures. 2. "Loa`n" means a Mortgage Loan, or a Home Improvement Loan, or other advance of money or a participation of such loan or advances made pursuant to Parts 1 and 3 of Division 31 of the Code. 0.1°`° TANDEM DESIGNATION 3. "Mortgage Loans" means a mortgage, deed of trust, or other instrument which is secured by a lien on real property together with a note evidencing a long-term advance of money made for the financing or refinancing of residential real property. ARTICLE II Services and Improvements LOCALITY's adoption and implementation of the following pro- grams within the designated concentrated rehabilitation areas shall be conditions precedent to AGENCY'S obligation to provide the financ- ing assistance described in Exhibit A. A. Housing Assistance Services. LOCALITY shall adopt and/or continue programs that assist ow and very low income residents to afford decent, safe and sanitary housing, including improvements to the housing necessitated by the code enforcement effort required in Section B below. These housing assistance programs are described in Exhibit B of this Agreement. B. Code Enforcement. LOCALITY shall adopt or continue a pro- gram of housing code enforcement. LOCALITY's description of this code enforcement program is attached as Exhibit C. C. Relocation Services. LOCALITY shall adopt or continue programs, which provide relocation advisory assistance and payments as prescribed by law (including the Code) and AGENCY regulations. LOCALITY shall provide certification (Exhibit D) to AGENCY with respect to each Loan for a unit not occupied by the owner that either: (1) Relocation would not be caused by making the Loan; or (2) LOCALITY will bear full responsibility for necessary relocation advisory assistance and payments. D. Affirmative Action. LOCALITY shall assist the AGENCY in implementing a program of Affirmative Action for contractors and subcontractors involved in the rehabilitation for construction of housing financed by AGENCY Loans (Exhibit E). (1) If the LOCALITY maintains a list of approved contractors, each contractor on such list will have submitted to the LOCALITY, and the LOCALITY will have approved, an Affirmative Action Pro- gram. Such program shall be no less than that required in the Code and AGENCY regulations. _ ~ ,- ~ ' T.~2~:JE,; DES I G?~r ; I OK -' (2) Where a contractor .is selected other than from an approved list, the.LOCALITY-is required only to make best _~ - efforts to assist contractors operating within the area to design and implement Affirmative Action Programs required by AGENCY Loan documents .- - _ E. Capital Improvements. LOCALITY shall provide specific cap'tal improvements. These improvements, the amount budgeted, - and the timetable for starting and completing the work are shown in xhibit F of this Agreement. _ _-_ F. Rent Limitation Complaints. LOCALITY shall adopt and/or con inue programs to review, verify and forward to AGENCY complaints made by tenants in housing financed by the AGENCY that rent limita- tion agreements made pursuant to AGENCY regulations have been violated (Exhibit G). - G. Citizen Partici ation. LOCALITY shall adopt and/or con- tinu a program to obtain participation of citizens within the area in t e implementation of a Neighborhood Preservation Program. Cer ification by Locality is attached as Exhibit H. H. Marketing. LOCALITY shall adopt and/or continue a program to i duce participation by local lenders and to inform the residents of t e existence of financial assistance available as a part of the Neig boyhood Preservation Program. Description of Locality's marketing program is attached as Exhibit J. ARTICLE III Term A. Term: This Agreement shall be in effect one cale day year,- July 1979 through June 1980. - B. Extension of Term. LOCALITY shall diligently proceed to adop , implement an en orce the programs set forth in Article II of t is Agreement. If AGENCY-finds the LOCALITY to be in substantial comp fiance with the commitments contained in Article II, AGENCY, at --COCA ITY's request, may agree to renew this Agreement for term to be determined by AGENCY. . C. Condition Subsequent. AGENCY's obligation to continue the fina cing assistance programs shall cease, or be suspended for such time as may be determined by AGENCY, if: (1) LOCALITY has failed to comp y with any of the conditions set forth in this Agreement; (2) GENCY determines that the programs adopted by LOCALITY are not bein implemented on a reasonable time schedule; or (3) AGENCY becomes ~~oa TANDEM DESIGNATION ,, unable to obtain funds by public or private sale of its underlying notes or bonds at an interest rate which would allow AGENCY to provide financial assistance at an interest rate sufficiently low so as to make the financial assistance programs feasible. ARTICLE IV Status Reports LOCALITY shall prepare and submit to AGENCY for review pro- gress and status reports on the rehabilitation assistance program. Such reports should be submitted to AGENCY no later than fifteen (15) days after the close of each quarter of LOCALITY's fiscal year. Reports submitted to AGENCY shall include at least the following information on program activity by quarters: (1) Number of code inspections made; (2) number of Loan or grant applications received by LOCALITY; and (3) number of Loans or grants (and dollar amount) paid out by LOCALITY. In addition, the report should include de- scriptions of the progress and status of each of the programs approved and implemented pursuant to Article II, including date of adoption and implementation, funds budgeted, and funds expended (both quarterly and cumulative since the programs' adoption). The reports should include LOCALITY's evaluation of AGENCY's financing assistance program. This letter introduces the Ci y's Rehabilitation Housing Inspector, the Housing Rehabilitation Administrator an explains the Housing Rehabilitation Program. From this letter, appointments ar made to inspect the housing units. Those owners who do not respond initially ar sent a second letter approximately 60 days later. If a response is still not re eived, the Inspector and Administrator contact owners and tenants on a door- to door basis. Since the Code Enforcement Program is mandatory, this procedure is continued until all units have been inspected. In the designated rehabilitation neighborhood, compliance is mandatory for all he lth and safety code violations. Violations are identified by the Inspector an a letter is sent notifying the property owner that all violations must be co rected within 90 days. The letter also informs the owner of the low-interest to ns that are available to bring the property up to code. Title: Community Development Director E~:.._~I'~' J. Marketing/Staffing The City's marketing approach is to utilize the citizen participation process, media publicity and general advertising. In each CRA neighborhood there exists a citizen organization which disseminates information on the City's Rehabilitation Loan Program. Additionally, the program receives excellent coverage on the pro- gram from the local newspaper. The City also has posted information in area shops and public buildings advertising the program. Integration of CHFA's loans into the City's program will require an expansion of the City's current advertising program. Upon selection of Chula Vista to parti- cipate in the program, a publicity campaign describing the program will be under- taken through local newspapers and City organizations. Another marketing avenue will be the local realtors who are in support of the program. RESOLUTION 79-58 TANDEM DESIGNATION ~J~ti WHEREAS, the California Housing Finance Agency (the "Agency") desires to enter into a program of financing assistance within m v of Chula ~~ista (the Locality") and WHEREAS, the Locality has agreed to provide certain services and improvements; and WHEREAS, as required by Sections 51302 and 51308 of the Health and Safety Code, the Agency finds that: 10 11 12 13 14 15 16 17 18 19 • These areas were selected by the legislative body, after an approved citizen participation process which meets the legislative requirements. • The concentrated area is an area of substantial deteriora- tion of residential structures, as evidenced by a signifi- cant number of older and deteriorating residential structures in such area requiring rehabilitation. • Rehabilitation assistance is necessary to enable and encourage residents in the concentrated area to cooperate in a Local program of concentrated enforcement of rehabili~ tation standards. s Rehabilitation of residential structures will arrest deterioration in the concentrated area. • The Local agency has offered to contract with the Agency to (1) provide necessary supporting neighborhood public improvements and services, such as street improvements, landscaping and acquisition of open space, undergrounding of utility lines, and construction of drainage facilities in the area for which eligibility has been requested, and (2) provide concentrated continuing enforcement of rehabilitation standards in such area. 20 • The local agency has agreed to make every effort to pre- vent unnecessary displacement in accomplishing rehabilita- 21 tion and has an adequate program of relocation advisory assistance for persons unavoidably displaced due to 22 rehabilitation. ~ • The supply of housing available to very low income house- i:~ _ ~ holds at affordable rents and the supply of housing avail- = able to other persons and families of low or moderate _ income at affordable rents will not be reduced within the '. 25 concentrated area because those displaced will receive relocation payments and be able to obtain standard housing 26 in the area.
