This program is to provide incentives and rewards to local governments for building affordable housing by providing grant money for much needed parks in the communities. ENVIRONMENTAL REVIEW The Environmental Review Coordinator has reviewed the proposed activity for compliance with the California Environmental Quality Act (CEQA) and has determined that the activity is not a "Project" as defined under Section 15378 of the State CEQA Guidelines because the proposed action consists of a governmental fiscal activity which, on its own, would not result in a potentially significant physical impact on the environment. However, when the actual project(s) for which the grant monies are earmarked are adequately defined and ready to be carried out, the appropriate environmental review and documentation will be required. Therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. RECOMMENDATION Council adopt the resolution. 10-1 BOARDS/COMMISSION RECOMMENDATION Not Applicable DISCUSSION The State of California recently released a notice of funding availability for the Housing- Related Parks Program (HRP). This program is funded through the passage of Proposition 1C, which creates incentives and rewazds local governments for building affordable housing by providing grant money for needed parks in those communities. The grant funds may be used for the creation, development or rehabilitation of park and recreation facilities. In order for the City to be eligible for the grant the City must have an approved Housing Element and Annual Progress Reports on file with the State of California. The City must also have construction approval of low income units within the program year of the application period. The affordable housing project which allows the City to be eligible for this grant is the Landings II, a 143 unit complex under construction in Otay Ranch Village 2. The grant award is based on the number of bedrooms in newly constructed affordable units. In addition, the City is also eligible for bonus awazds for selecting a pazk which is located in a low/moderate income census tract, apark-deficient area or in an area which is included in an adopted regional comprehension plan. In selecting the park for improvements, City staff considered the potential bonus opportunities, parks with the greatest need and improvements which would maximize on the grant amount the City will receive. For these reasons, grant funds will be utilized for improvements to Hilltop Park. Based on all the criteria and considerations, the City is eligible to receive approximately $317,100 of grant funds. These funds aze not competitive in nature and are available to all jurisdictions meeting the requirements. DECISION MAKER CONFLICT Staff has reviewed the property holdings of the City Council and has found no property holdings within 500 feet of the boundazies of the properties which aze the subject of this action. ONGOING FISCAL IMPACT There is no ongoing fiscal impact from the one-time grant. City staff time reimbursement to design and complete the project would be covered through the grant. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA AUTHORIZING THE SUBMITTAL OF AN APPLICATION FOR A HOUSING RELATED PARKS GRANT FROM THE STATE OF CALIFORNIA DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT WHEREAS, the State of California, Department of Housing and Community Development (Department) has issued a Notice of Funding Availability dated May 28, 2010, under its Housing Related Parks (HRP) Program; and WHEREAS, the City of Chula Vista desires to apply for a HRP Program grant and submit the 2010 Program Year Application Package released by the DepaRment for the HRP Program; and WHEREAS, The Department is authorized to approve funding allocations for the HRP Program, subject to the terms and conditions of the Notice of Funding Availability Program Guidelines, Application Package, and Standard Agreement. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that the City Manager is hereby authorized and directed to apply for and submit to the Department the HRP Program Application Package released December 2010 for the 2010 Program Year. If the application is approved, the City Manager is hereby authorized and directed to enter into, execute, and deliver a State of California Standard Agreement (Standard Agreement), and any and all other documents required or deemed necessary or appropriate to secure the HRP Program Grant from the Department, and all amendments (collectively the "HRP Grant Documents"). BE IT FURTHER RESOLVED that the City of Chula shall be subject to the terms and conditions as specified in the Standard Agreement. Funds are to be used for allowable capital asset project expenditures to be identified in Exhibit A of the Standard Agreement. The application in full is incorporated as part of the Standard Agreement. Any and all activities funded, information provided, and timelines represented in the application are enforceable through the Standard Agreement. The City of Chula Vista hereby agrees to use the funds for eligible asset(s) in the manner presented in the application as approved by the Department and in accordance with the Notice of Funding Availability and Program Guidelines and Application Package.
