RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA APPROVING THE TENTATIVE SUBDIVISION MAP FOR
CHULA VISTA TRACT 79-17, KIP~BALL TERRACE
The City Council of the City of Chula Vista finds as
That in accordance with the attached Negative Declara-
ti n, IS-77-11 and the findings therein, the proposed tentative
ma will not have a significant impact upon the environment, and
th City Council hereby certifies that the Negative Declaration
wa prepared in accordance with the California Environmental Quality
Ac of 1970, as amended.
The City Council of the City of Chula Vista does hereby

WHEREAS, the Planning Commission of the City of Chula
Vi to has heretofore approved that certain tentative map of a

ma subject to the conditions contained in Planning Commission

NOT.a, THEREFORE, BE IT RESOLVED that the City Council
of the City of Chula Vista does hereby approve said tentative sub-
di ision map in accordance with Planning Commission Resolution No.
PCS-7A-17 .

Environmental Review Committee of the City of Chula Vista
recommended that the: Planning Commission & City Council
d that the project noted below will not result in any significant
ironmental impact. The project is described as follows:
Rezoning of .44 acres and construction of a 5 unit apartment complex
un erground parking for 10 vehicles plus 2 on-site spaces and
as ociated landscaping.

Th finding that the project will not have a significant effect on
th environment is based on the following reasons:
1. The project site is~void of any significant natural
or man-made resources which could be adversely effected by
implementation of the project and there are no known geologic
hazards within the immediate vicinity of the area which could
substantially impact new development. '
2. The proposed rezoning is in conformance with the GenFral
Plan land use element; all potential impacts regarding tr~iffic
circulation, parks and recreation and community services t.ave
been mitigated to an insignificant level or eliminated; and
the project is not anticipated to achieve short-term to the
disadvantage of long-term environmental goals.
3. No impacts which could interact to create a substantial
adverse cumulative effect on the environment are anticipated
to result from the proposed action.
4. A HUD noise analysis has found that noise levels generating
from vehicle traffic on Third Ave. are within the "normally"
acceptable range indicating that no adverse acoustical impact
on human beings will result.

The project involves a request for a zone change which would increase
res dential density on the project site. The existing 2-1 zoning
of he site would permit the development of t°.ao single family
dwe lings while the proposed rezoning to R-3-p-12 would permit five
dwe ling units. This rezoning is in conformance with the General
Pla ~-
Alm st all of the property in the vicinity of the project is
cur ently zoned for various multi family and .,mercial uses. The
pro erty immediately to the northwest of the;p~ject on the south
sid of Third Ave. is zoned R-l. That property has a similar
top graphic orientation to Third Ave. and a~request for an increase
in 'ntensity could result from the approval of this request. The
R-1 area to the northwest is of a similar size to this project
sit and even considered cumulatively, there woad be a population
inc ease of about 20 people which is not signif~.cant.
The substantial topographic changes between .the project site and
the existing single family development to the southwest will
pre lode any substantial impact on the character and stability of
the developed single family area.

Schools
The project area is served by the following schools with their
cur ent attendance and capacities:

Thu the elementary and junior high school facilities are currently
ove capacity. Because of the scale of the project it will not
hav any substantial direct impact on the environment. Cumulatively,
the school districts have indicated that if the developer will
ass st in a short range accommodation of the additional students,
on long term basis the students can be accommodated due to a
dec ine in enrollment, changes in school boundaries and changes
in ussing patterns. There will be therefore, no substantial
adv rse impact on the provision of educational services.
Parks
The par}: service district in which this project is located has
a r quirement for 4.4 acres of park area, there are no park
fac lities within the service district. This project will
res It in the need for .Ol additional acres of park land which is
not a substantial amount. The project proponent will be required
to ay the necessary park fees toward purchase and development
of ark facilities. Additionally there is an existing community
par facility 1/4 mile west of the project. '
Cum latively, as development takes place there ~~ill be less vacant
lan and a cecreasing opportunity to obtain necessary neighborhood
fac lities in this service district. To mitic_ate that impact, an
ova uation of the vacant land in the district and which sites would
be ore appropriate for park purposes should be carried out and
pur hase of necessary land undertaken.
Traffic F?azards
Thi segr„ent of Third Ave. has slight sight distance problems
ass ciated with vehicles entering onto and existing from the

traffic could aggravate the problem. The existing average daily
traffic is 6146 trips which rpovides a level of service B. The

are other approved, planned and probable future project which

tra fic are not substantial enough to signifcantly lower the service

ade uate breaks in the traffic flow to permit safe right hand
tur s into and out of the project. The applicant has also agreed
to liminate the southerly project entrance limiting access to the
mos northerly driveway which has adequate sight distance for

RESOLUTIONd OF THE CITY PL;F;i~iING COMMISSION RECOMMENDING TO
THE CITY COUNCIL THE APPROVAL OF THE TENTATIVE SUBDIVISION
MAP FOR CHULA VISTA TRACT 79-17, KIMBALL TERRACES
WHEREAS, on May 3, 1979 Michael Roark submitted a tentative subdivision map
or Chula Vista T-~ace 79-17, Kimball Terraces, for a one lot, five unit condominium
tructure at 80 Third Avenue, and
WHEREAS, Section 66473.5 of the State Map Act provides that approval of a
ut~!ii/ision map shall be based upon findings of consistency between the subdivision
ap and the adopted General Plan of the local jurisdiction, and
WHEREAS, the Planning Commission set the time and place fora public hearing
o consider said tentative map, and notice of said hearing, with its purpose, was
given ~y the publication in a newspaper of general circulation in the city at least
l days prior to the date of said hearing, and
WHEREAS, a hearing was held at said time and place, namely 7:00 p.m.,
J ne 27, 1979 in the City Council Chambers before the Planning Commission and said
h aring was thereafter closed, and
WHEREAS, a Negative Declaration on IS-77-11 for development of the site was
a opted by the Planning Commission on h1arch 23, 1977.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. From facts presented to the Planning Commission, the Commission finds
t at the subdivision map for Chula Vista Tract 79-17, Kimball Terraces, is consis-
t nt with the goals and objectives of the Chula Vista General Plan based on the
following:

a. Land Use Element - The General Plan designates this site for medium
density residential (4-12 DU/acre) and the development is proposed
at 11 DU/acre. The proposed subdivision is in conformance with
the adopted precise plan and the R-3-P-12 zoning.
b. Circulation Element - The completion of improvements on the site
along Third Avenue is in conformance with the major street sections of
the General Plan.
c. Housing Element - The Housing Element is not affected by a five unit
development.
d. Conservation, Open Space, Parks and Recreation Elements - The project
is designed to fit in and blend with the terrain. No endangered
species or natural resources have been identified on the site. The
developer will be assessed in lieu park fees in conformance with the
Municipal Code.

e. Seismic Safety and Safety Elements - There is no indication of
historic seismic activity on the site. Extension of public
improvements will meet or exceed Safety Element standards.
f. Noise Element - The applicant is required to construct the units in
accordance with State standards to reduce noise levels in the building
to acceptable levels. Portions of outside activity areas are screened
as well.
g. Scenic Highways Element - The site does not abut a "scenic route" or
"gateway."
h. Bicycle P.outes Element - While Third Avenue is not designated as a
bicycle route, the street is wide enough to accommodate the traffic
mix of cicycles and motor vehicles.
2. The Planning Commission recommends to the City Council that the tentative
p for Chula Vista Tract 79-17, Kimball Terraces, be approved, subject to the
llowing conditions:
a. The owner shall offer for dedication on the final map a 10 foot wide
strip of land, 5 feet on each side of the center line of the
existing 36" R.C.P., and an 11 foot wide strip of land, 5.5 feet on
each side of the center line of the existing 51" R.C.P., t~ the
City as easements for drainage purposes.
b. Prior to recordation of the final map, the owner shall dedicate
sufficient right-of-way to the City to provide fora minimum 30 foot
radius curb return and a minimum distance of 8 feet from face of
curb to property line. The owner shall also dedicate a 7.5 foot strip
of land along Third Avenue and a 5.5 foot strip of land along Kimbal~
Terrace to the City as easements for street tree purposes prior to
recordation of the final map.
c. A soils engineer's certificate shall be placed on the map.
d. The median island on Third Avenue shall be shown on the tentative
map together with proposed left turn accommodations.
e. The storage areas shall be revised to allow for the opening of car
doors within the garages and to provide from 40 to 80 cubic feet of
storage space adjacent to each unit.
3. That this resolution be transmitted, along with the Tentative Map, to
City Council and a copy of this resolution be transmitted to the applicant.
