RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA APPROVING THE TENTATIVE SUBDIVISION MAP FOR
CHULA VISTA TRACT 79-20, VILLA ANTIGUA
The City Council of the City of Chula Vista finds as
That in accordance with the attached Negative Declara-
~, IS-79-26 and the findings therein, the proposed tentative
will not have a significant impact upon the environment, and
City Council hereby certifies that the Negative Declaration
prepared in accordance with the California Environmental Quality
of 1970, as amended.
The City Council of the City of Chula Vista does hereby
res lve as follows:
WHEREAS, the Planning Commission of the City of Chula
Vis a has heretofore approved that certain tentative map of a
sub ivision to be known as Chula Vista Tract 79-20, Villa Anti ua
and has recommended that the City Council approve said tentative
map subject to the conditions contained in Planning Commission
Res lution No. PCS-79-20, adopted on the 11th day of July
1979, a copy of which is attached hereto and by this reference made
a pa thereof the same as though fully set forth herein.
NO?a, THEREFORE, BE IT RESOLVED that the City Council
of t e City of Chula Vista does hereby approve said tentative sub-
divi ion map in accordance with Planning Commission Resolution No.
PCS- 9-20 .

adverse soil conditions known to exist.
B. Project Description
T e applicant proposes to construct a two story, 11 unit condominium
p oject. Two one bedroom units and 9 two bedroom units are planned.
O -site parking for 18 vehicles will be provided as well as 3735 sq.
f of landscaping (including walks).
C. Compatibility with zoning and plans
The applicant has submitted a request for a variance to reduce existing
on-site setbacks. The variance involves reducing the Del Mar Ave.
exterior side yard setback from 50 ft. to 10 ft. and the I St. front
from 25 ft. to 15 ft. These reductions are in conformance with the
R-3 zone and will not affect the site's residential density established
for the General Plan.

The project is located along a portion of Del Mar Ave. which is a
si gle family residential neighborhood with large lots. The
existing residences have substantial setbacks from the roadway and
because Del Mar Avenue's 80 ft. right-of-way with narrow curb to curb
wi th, there is an almost rural atmosphere.
If the requested variance in setbacks is granted, the proposed two
st ry building could be considered imposing due to its bulk and
location relative to adjacent roadways.

Th local elementary and jr. high schools are currently operating over
ca acity. New students from the proposed project will further
in rease current enrollments. Developers contributions will be
re wired to be submitted to the Chula Vista Elementary and Sweetwater
Union High School Districts and will provide temporary classroom
sp ce for new students. School district policies relating to
bo ndary changes and school assignments will also serve to reduce
an potential impact.
Parks & Recreation
Th proj•ect is located within City park district 5.01 which is void
of any dedicated neighborhood parklands. About .06 acres of park
ar a would be required to service residents of the new dwellings.
Si ce the project site is of limited acreage, residential construction
to in lieu of land dedication will be required to asist in financing
future park development within the district.

Mitigation necessary to avoid significant impact
1. Adequacy of proposed setbacks relative to the effect on
the adjacent residential community should be carefully considered.
2. A letter from the appropriate school districts verifying
available spece for new students will be submitted prior to
project approval.
3. Residential construction tax will be required to contribute
to the financing of future park development with the appropriate
park district.
Findings of insignificant impact.
1. The site is generally void of any significant vegetation
and there are not any geologic hazards or adverse soils
conditions in the vicinity of the project.
2. The project is in conformance with the land use element of
the General Plan and is not anticipated to achieve short term to
the disadvantage of long term environmental goals.
3. No impacts are anticipated to occur which could interact
to create a cumulative effect on the environment.

increase in traffic or related emissions and no substantial
increase in ambient noise levels are anticipated to occur.

CITY COUfJCII THE APPP,OVAL OF THE TENTATIVE SUBDIVISION h1AP FOR
CHULA VISTA TRACT 79-20, VILLA ANTIGUA
WHEREAS, a tentative subdivision map for Chula Vista Tract 79-20, Villa
~tigua, was filed by Hermosa Corporation on May 18, 1979 for the development
f a 15,822 square foot parcel at the southwest corner of Del P1ar Avenue and
I" Street into an 8 unit condominium project, and
LJHEREAS, Section 66473.5 of the Government Code provides that approval of
subdivision map shall be based upon findings of consistency between the sub-
ivision map and tite adopted General Plan of the local jurisdiction, and
WHEREAS, the Planning Commission set the time and place for a public
aring to consider, said tentative map, and notice of said hearing, with its
rpose, was given by the publication in a newspaper of general circulation in
city at least 10 days prior to the date of said hearing, and
WHEREAS, a hearing was held at said time and place, namely 7:00 p.m.,
J~ly 11, 1979 in the Council Chamber, City Hall, before the Planning Commission
said hearing was thereafter closed, and
l~1HEREAS, the proposed project was determined to be exempt from environ-
tal review as a Class 1(k) exemption.
NOW THEREFORE BE IT RESOLVED AS FOLLOl~1S:
From facts presented to the Planning Commission, the Commission finds that
t e subdivision map for Chula Vista Tract 79-20, Villa Antigua, is consistent with
t e goals and objectives of the Chula Vista General Plan based on the following
f ndings:
1. The site is physically suitable for residential development since
the site plan conforms to all standards established by the City for
residential development and the site contains adequate access to
public streets.
2. The design of the subdivision will not affect the existing improvements;
streets, sewers, etc.; which have been designed to avoid any serious
health problems.
3. The subdivision is consistent with the General Plan Elements as
demonstrated by the following:
a. Land Use Element - The General Plan designates this site for high
(~~ ~ density residential development (13-26 dwelling units per gross
I~ acre). The proposed project density of 20 dwelling units per acre
is consistent with this designation.
b. Circulation Element - The subdivision is not adjacent to any
streets designated on the General Plan for major or collector roads.
c. Housing Element - Inasmuch as the subdivision contains fewer than
fifty units, it is exempt from the requirement to address the need
to provide 10% of the units for low and moderate income families.
d. Conservation, Open Space, and Parks and Recreation Elements - None
of the areas proposed for conservation or open space on the various
plan diagrams of the General Plan are affected by the subject proposal:
The developer will be assessed fees in lieu of park land dedication.
e. Noise Element - The lot will not be subject to objectionable noise
levels.
f. Seismic Safety and Safety Elements - The development is not adjacent
to any known fault systems.
g. Scenic Highways Element - The site does not abut a Scenic Highway or
gateway.
h. Bicycle Routes - No bicycle routes are proposed on or adjacent to
this site.
i. Public Buildings Element - Public buildings are neither proposed nor
required on the site.
BE IT FURTHER RESOLVED:
1. That the Planning Commission recommends that the City Council approve
tie tentative subdivision map for Chula Vista Tract 79-20, Villa Antigua, subject
t~ the condition that all storage areas accessible from the outside shall be
cured with security type hinges utilizing a nonremovable pin, a solid core door
ar~d a single cylinder deadbolt (minimum 1" throw) lock.
2. That this resolution be transmitted, along with the Tentative Map, to
e City Council, and a copy of this resolution be transmitted to the applicant.
