HomeMy WebLinkAboutReso 1989-14104 Revised 5/19/89 RESOLUTION NO. 14104 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING A MODIFICATION TO PRECISE PLAN P-87-9 TO INCREASE ALLOWABLE FLOOR AREA ON 7 LOTS WITHIN PLANNING AREA 3 The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the Fieldstone Company requested a modification to the Sunbow Precise Plan, P-87-9, in order to increase the maximum allowable floor area from 2,550 sq. ft. or 45% of the lot area (whichever is greater) to 55% of the lot area for 12 lots within Chula Vista Tract 87-8, Unit No. 3, located at the southwest quadrant of East Naples Street and Medical Center Drive in the P-C Planned Community zone, and WHEREAS, the proposal is exempt from environmental review, and WHEREAS, on April 26, 1989, the Planning Commission voted 5-0 to recommend that the City Council approve the following amendment to the Sunbow Precise Plan, P-87-9, for Planning Area 3 in accordance with Resolution P-87-9(A): Maximum Building Area: 2,550 square feet or 45% of the lot area, whichever is greater; except that lots 20 (54%), 22 (50%), 23 (50%), 43 (51%), 44 (52%), 49 (49%) and 53 (49%) shall be permitted the maximum building area as noted. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby approve the modification of the Sunbow Precise Plan as recommended by the Planning Commission upon the condition listed below and based on the following findings: 1. That such plan will not, under the circumstances of the particular case be detrimental to the health, safety or general welfare of persons residing or working in the vicinity, or injurious to property or improvements in the vicinity. The increased building areas will occur on lots interior to the project, and thus the modification will not result in an adverse impact on adjoining residents. -1- 2. That such plan satisfies the principle for the _ application of the P modifying district as set forth in Section 19.56.041. The proposal satisfies the principles for the original application of the P modifying district in that the area is subject to development standards which are unique to the project, and which allow greater flexibility because of the comprehensive planning approach involved. 3. That any exceptions granted which deviate from the underlying zoning requirements shall be warranted only when necessary to meet the purpose and application of the P precise plan modifying district. The modification is consistent with the original intent of the development standards to allow a reasonable mix of one-and two-story buildings in Planning Area 3. 4. That approval of this plan will conform to the general plan and the adopted policies of the city. Approval of the proposal is consistent with General Plan policies for planned developments. The condition of this approval is that it shall not become effective until the applicant shall first deposit $1500 for each unit subject to the increase in floor area ratio. Said money shall be placed in a fund to be used for park and open space improvements in this area.
