HomeMy WebLinkAboutAgenda Statement 1979/06/12 Item 05~iiY ur ~riuL.u VI~IH COUNCIL AGENDA STATEMEiVT Item No.~ 5 For meeting of 6/12/79 ITEM TI TLE SUBMIT1fED BY ITEM ED(PLANATION (4/5TH'S VOTE REQUIRED YES NO x ) On December 12, 1978, the City Council adopted Resolution No. 9399 accepting a petition to establish a 1911 Act District in the 1100 block of Walnut Avenue and directing the City Engineer to proceed with the formation of the District and to prepare plans, specifications and cost estimate. Since the petition was sig ned by property owners representing 70.94 of the assessed land within the boundaries of the proposed assessment district, the project is exempt from the requirements of the Special Investigation, Debt Limitation and Majority Protest Act of 1931 in accordance with Section 2804 of the Streets and Highways Code. On May 22, 1979, by Resolution No. 9607, the City Council adopted the Resolution of Intention in accordance with Sections 5130 through 5135 of the Streets and Highways Code and set June 12, 1979, as the date for a public hearing to hear any objections to the formation of the improvement district. Avenue from 192 Feet Northerly o Palomar Street to 735.5 Feet Northerly) City Engineer Agenda Item No. 5 For Meeting of 6/12/79 Supplemental Page Two According to Section 5221 of the Streets and Highways Code, the City Council must hear and pass upon all written protests made against the formation of a 1911 Act Improvement District as proposed in the Resolution of Intention and as shown on the proposed district boundary plat. If the protest against the proposed work is made by the owners of less than one-half of the area of the property to be assessed for the improvements, the City Council may overrule the protest by majority vote. If the protest against the proposed work is made by the owners of more than one-half of the area of the property to be assessed for the improvements, the City Council may overrule the protest by an affirmative vote of four-fifths of the members of the City Council. Failure to do so would stop all proceedings for a period of one year from the date of the decision of the legislative body on the hearing. If the City Council overrules the protest in accordance with Section 522.5 of the Streets and Highways Code, the City Council shall immediately acquire jurisdiction to order the proposed work to be done. As of June h, 1979, no written protests have been received by the City Clerk. This is the first of two public hearings that will be held for this project. The second hearing is on the spread of assessments. After the work is completed staff will prepare a final assessment for each parcel based on the actual cost of the work. At this second hearing, property owners may protest the method of assessments. The City Council also at its meeting on May 2?_, 1979, by Resolution No. 9505 adopted the proposed district boundary map for 1911 Act Improvement District 79-1. This map was recorded in the Office of the County Recorder on May 23, 1979, as Document No. 79-212539. The improvements to be installed include curb, gutter, sidewalk, driveways, street paving, sewer facilities, street light and relocation of water facilities. The estimated cost for construction for these improvements is $77,500 which includes 10$ for contingencies. Total project cost including incidentals (engineering, title reports, inspection, water service relocation, purchase of existing sewer force main, sale of bonds, surveying, administrative costs such as advertising, printing of bonds, etc.) is estimated at $98,028. The plans, specifications and Cost Estimate for the project were approved by City Council Resolution No. 906. A preliminary assessment cost has been prepared for each parcel within the District.
