be Done and Improvements to be Made Under the Provisions of the Improvement
Act of 1911 and Amendments thereto in the 1100 Block of Walnut Avenue
from 192 feet Northerly of Palomar Street to 735.5 feet Northerly and
to Establish Date of Public Hearing on the Formation of the District 79-1

On December 12, 1978, the City Council adopted Resolution No. 9399
ac epting a petition to establish a 1911 Act District in the 1100
bl ck of P7alnut Avneue and directing the City Engineer to proceed
wi h the formation of the District and to prepare plans, specifications
an cost estimate. The petition was signed by property owners
re resenting 70.940 of the assessed land within the boundaries of
th proposed assessment district. This exempts the proceedings from
th requirements of the Special Investigation, Debt Limitation and
Ma'ority Protest Act of 1931 ',in accordance with Section 2804 of
th Streets and Highways Code.
On previous items of tonight's agenda, Council has been requested to
ad pt the district boundary map, plans, specifications and cost
es imate and other procedural. matters related to the 1911 Act
pr cedures. In addition to these items, sections 5130-5136 of the
St eets and Highways Code require that Council adopt a Resolution
of Intention before ordering any work to be done under the provisions
of the Improvement Act of 1911. The Resolution of Intention is the
ke stone resolution of a 1911 Act proceeding and therefore must contain
se eral legal items. The resolution shall state in general terms
th class or kinds of work to be performed and shall refer to plans
wh'ch have been completed and shall fix a date for a public hearing.

an and all persons having objections to the proposed work or for
th m to show cause why the proposed work should not be carried out
in accordance with the Resolution of Intention.

e improvements to be installed include curb, gutter, sidewalk,
iveways, street paving, sewer facilities and a street light. The
mplete plans for this work are contained in Chula Vista Drawing
. 78-24D. The estimated cost fo this project totals $98,028.
e construction of the improvements is $77,500 which includes 100
r contingencies. The incidental expenses (Engineering, title
ports, inspection, water service relocation, purchase of existing
wer force main and sale of bonds, etc.) are estimated to total
0,528. Attached is a complete estimate of the above cost.
P operties within the District will be assessed equitably according
t benefits received. Surface improvements and incidental expenses
w'll be assessed on the basis of frontage (700) and area (30%).
S wer improvements will be assessed on the basis of area to be served
( OOo). A preliminary assessment cost has been prepared for each
p rcel. within the District. The cost to the property owner could
v ry from $1,500 to $12,300. Individual property owners have been
i formed prior to tonight's meeting of their estimated share of
c st for the proposed improvements. After the work is completed,
C uncil and the property owners will be presented with a final
a sessment roll in accordance with 1911 Act procedures. It is
e pected that property owners will elect to pay for their assessment
t rough a 10 year serial bond bearing an 8o interest rate.
I accordance with the Streets and Highways Code, at any time prior
t 7:00 p.m. on June 12, 1979, any owner of property liable to be
a sessed for. the work may make written protest against the proposed
w rk or against the extent of the district to be assessed. Such
p otest must be in writing. All such protest shall be delivered
t the City Clerk and no other protests or objections shall be
c nsidered.
