~LE Resolution Declaring the Intention of the City Council
to Vacate Public Street (Madison Avenue south of "H" Street)
and Fixing Time and Place for a Public Hearing Thereon

ITEM EXPLANATION
On D cember 12, 1978, Ms. Harriett R. Stone submitted a request to
vaca e a segment of Madison Avenue running southerly 290 feet from
"H" treet.
This portion of Madison Avenue was dedicated by the owner in 1955
for treet purposes. The intention at that time was to provide for
a fu ure connection from "H" Street to an existing portion of
Madi on 330 feet southerly extelnding south to "I" Street. Since
then, however, the residential ;portion to the south has been
modi ied to a cul-de-sac and the parcel between the two street
segm nts is now Chula Vista Squlare Shopping Center and Nurseryland.
The etitioner owns all propert',ies on the east and west sides of the
subj ct street. The southerly terminus of the street is bounded by
prop rty under different ownersjhip. All these properties are zoned
comm rcial. The southerly property owner's agent has been advised
that the street vacation is in process. We have not received any
indi ation of whether this owner is in support of the proposed
vaca ion.
Ms. tone is planning to renovate her properties adjacent to Madison
Aven e and proposes to use the vacated portion for additional parking
and andscaping.
The treet Vacation Act of 1941 requires that a Public Hearing be held
to h ar people in favor of or objecting to the proposed street vacation.

BOARD/CO MISSION RECOMMENDATION
The lanning Commission recomme#~ded on May 9, 1979, the vacation of
Madi on Avenue subject to the condition that the petitioner grant
a 25 foot easement for ingress and egress to the southerly property owner.
