The program provides assistance to local govenm~ents to fund rubberized asphalt concrete (RAC) projects including hot mix and chip seal. There are two types of grants: (1) Targeted Rubberized Asphalt Concrete Incentive (Targeted) and (2) Rubberized Asphalt Concrete Chip Seal (Chip Seal) of which there is available funding. The application deadline for Fiscal Year 2010-2011 is February 16, 2011. The City proposes to apply for Rubberized Asphalt Concrete grant funding for pavement projects within the City utilizing the StreetSaver software program. This action is intended to inform Council that staff is preparing the grant application and plans to submit it before the Febniary 16, 2011 deadline. Should any grant funds be awarded, staff will return to Council for appropriation to an eligible project. ENVIRONMENTAL REVIEW The Development Services Director has reviewed the proposed activity for compliance with the California Environmental Quality Act (CEQA) and has determined that the activity is not a "Project" as defined colder Section 15378 of the State CEQA Guidelines because the activity consists of solicitation for grant fiords to be used for future projects which the City of Chula Vista has not yet approved, adopted or provide the necessary funding. Therefore, approval of this action would not result in direct or indirect physical changes to the environment and as such, 7-1 2/]/11, Item ~ Page 2 of 3 pursuant to Section 15060(c) (3) of the Stale CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is necessary. RECOMMENDATION Council adopt the resolution. BOARDS/COMMISSIONS Not applicable. DISCUSSION The California Department of Resources Recycling and Recovery (CalRecycle), formerly known as the California Integrated Waste Management Board (CIWMB), provides the Rubberized Asphalt Concrete (RAC) Grant Program to promote markets for recycled-content surfacing products derived from waste tires generated in California and decrease the adverse environmental impacts created by unlawful disposal and stockpiling of waste tires. For fiscal year 2010-2011, a total of $3,509,334 is available for the Targeted RAC Grant and $2,000,000 is available for the Chip Seal Grant. Applicants may apply for funding for a single project or may include two or~more projects of the same type. The maximum grant award is $250,000 for either Target or Chip Seal grants, which may be combined into one application packet for a maximum request of $500,000. Eligible costs include expenditures incurred during the grant term that are directly related to the project(s) rubberized paving material and its installation. All projects are subject to the following requirements: • One hundred percenC (100%) California-generated waste tires must be used in the rubber portion of the project(s). • Reimbursement will not exceed the amount stated on the Grant Agreement Cover Sheet (CalRecycle 110). • Construction of the RAC portion of any project must commence on or after the date indicated in the Notice to Proceed and be completed by April 1, 2013. • The binder material must contain a minimum of 300 pounds (equivalent to 15 percent by weight) of the tire-derived crumb rubber per ton of rubberized binder. For Targeted RAC Incentive Grant, project(s) must use a minimum of 3,500 tons of RAC. For RAC Chip Seal Grant, project(s) must use a minimum area of 35,000 square yards of RAC chip seal material. This agenda statement is intended to inform Council of staff's intention to apply for these grant funds and to authorize its submittal of the application to CalRecycle. It is also intended to authorize the Director of Public Works/City Engineer, or his/her designee the power to execute in the name of the City of Chula Vista all grant documents, including but limited to, applications, agreements, amendments and requests for payments, necessary to secure grant funds and implement the approved grant project, if awarded. ~-2 2/1/11, Item Page 3 of 3 DECISION MAKER CONFLICT Sriff has reviewed the decision contemplated by this action and has determined that it is not site specific and consequently the 500 foot rule found in California Code of Regulations section 18704.2(a)(I) is not applicable to this decision. CURRENT YEAR FISCAL IMPACT There is no impact to the General Fund. If the resolution is approved, the City will apply for Rubberized Asphalt Concrete grant funds. If a grant is awarded, staff will return to Council with a recommendation to accept and appropriate the grant funds to an eligible pavement project and/or project(s). ONGOING FISCAL IMPACT None. IR,4C Grnn~t Agenda Statement.doc 7-3 RESOLUTION NO. 2011- RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING THE APPLICATION FOR RUBBERIZED ASPHALT CONCRETE GRANT FUNDS AND AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO EXECUTE ALL DOCUMENTS NECESSARY TO SECURE SUCH FUNDS. WHEREAS, Public Resources Code sections 40000 et seq. authorize the Department of Resources Recycling and Recovery (CalRecycle), formerly known as the California Integrated Waste Management Board, to administer various Grant Programs (grants) in furtherance of the State of California's (State) efforts to reduce, recycle and reuse solid waste generated in the State thereby preserving landfill capacity and protecting public health and safety and the environment; and WHEREAS, in furtherance of this authority CalRecycle is required to establish procedures governing the application, awarding, and management of the grants; and WHEREAS, CalRecycle grant application procedures require among other things, an applicant's governing body to declare by resolution certain authorizations related to the administration of CalRecycle grants. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby authorize the submittal of application to CalRecycle for any and all grants for which the City of Chula Vista is eligible during the current grant cycle. BE IT FURTHER RESOLVED that the Director of Public Works/City Engineer, or his/her designee is hereby authorized and empowered to execute in the name of the City of Chula Vista all grant documents, including but not limited to, applications, agreements, amendments and requests for payment, necessary to secure grant funds and implement the approvgd gran project for the term of the current grant cycle, ending on June 30, 2013. ~~/ Presented by Appr~bved~ as Richard A.
