PCS-79-13 ~ ' RESOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING TO THE CITY COUNCIL THE APPROVAL OF THE TENTATIVE SUBDIVISION MAP FOR CHULA VISTA TRACT 79-13, OFFERMAN CONDOMINIUMS WHEREAS, on December 28, 1978 Charles and Barbara Offerman submitted a entative subdivision for Offerman Condominiums, a one lot, 17 unit condominium roject currently under construction at 440 "L" Street, and WHEREAS, Section 66473.5 of the State Map Act provides that approval of a bdivision map shall be based upon findings of consistency between the subdivision p and the adopted General Plan of the local jurisdiction, and WHEREAS, the Planning Commission set the time and place fora public hearing consider said tentative map, and notice of said hearing, with its purpose, was iven by the publication in a newspaper of general circulation in the city at least days prior to the date of said hearing, and WHEREAS, a hearing was held at said time and place, namely 7:00 p.m., bruary 14, 1979 in the City Council Chambers before the Planning Commission and id hearing was thereafter closed, and WHEREAS, the proposed project was determined to be exempt from environmental iew as a class 1(i) exemption. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. From facts presented to the Planning Commission, the Commission finds at the subdivision map for Chula Vista Tract 79-13, known as Offerman Condominiums, consistent with the goals and objectives of the Chula Vista General Plan based on following: a. The conversion of apartments under construction into a condominium does not affect the following Elements of the General Plan: Land Use, Circulation, Seismic Safety, Safety, Noise, Scenic Highways, Bicycle Routes, Public Buildings, Conservation, Parks and Recreation, and Open Space. b. Housing Element - The conversion of apartment units under construction will not reduce the inventory of rental units but will permit an expanded choice of housing ownership. 2. The Planning Commission recommends to the City Council that the tentative ap for Chula Vista Tract 79-13, Offerman Condominiums, be approved, subject to e following conditions: a. The tentative map shall be revised to show the following additions or 9 !~ corrections: -~ 1) Show the existing sewer main and water main in "L" Street. 2) Show all existing driveway approaches along the frontage adjacent to "L" Street. 3) Revise legal description to read "a portion of lot 20" instead of "all that portion of lot 20." 4) Add notes to indicate water source and sewage disposal provisions. b. The developer shall comply with all the requirements of the Chula Vista Municipal Code as it pertains to this subdivision. The final map shall be prepared in accordance with the City of Chula Vista Subdivision Manual. c. The developer shall pay the difference between the Residential Con- struction Tax for apartments and for condominiums. Since the units were constructed under the old apartment Residential Construction Tax rate of $175 + $12.50 for each bedroom over one, and the new condominiur~~ rate is $375 + $25.00 for each bedroom over one, the applicant must pay an additional $3,612.50. 3. That this resolution be transmitted, along with the Tentative Map, to he City Council, and a copy of this resolution be transmitted to the applicant.
